وقد نص مشروع المادة 17 المعنون " العلاقة بقواعد القانون الدولي الخاصة " على ما يلي: " لا تنطبق مشاريع المواد هذه مع قواعد القانون الدولي الخاصة السارية في حالات النزاع " .
