52- تلتمس إيران تعويضاً بمبلغ قدره 375 271 13 دولاراً عما تكبدته منظمة الطيران المدني من نفقات لتنظيف وإصلاح مرافق المطار التي تضررت من الملوثات المنقولة بالهواء والأمطار الحمضية الناجمة عن حرائق آبار النفط التي تسبب فيها غزو العراق للكويت واحتلاله لها.

In the view of the Panel, where proposed measures for the complete removal of contaminants are likely to result in more negative than positive environmental effects, such measures should not qualify as reasonable measures to clean and restore the environment, within the meaning of article 35(b) of Governing Council decision 7.

186- ويجد الفريق أنه بعد التعديلات الوارد ذكرها في المرفق الثاني تشكل تدابير الإصلاح المقترحة من جانب الكويت تدابير ضرورية بصورة معقولة لتنظيف وإصلاح البيئة، وذلك بالمعنى الوارد في الفقرة 35(ب) من مقرر مجلس الإدارة رقم 7.

The Panel went on to affirm that, in its view, where proposed measures for the complete removal of contaminants are likely to result in more negative than positive environmental effects, such measures should not qualify as reasonable measures to clean and restore the environment, within the meaning of article 35(b) of Governing Council decision 7.
ونص الفريق ليؤكد أن من رأيه، في الحالات التي يحتمل أن تؤدي فيها التدابير المقترحة لإزالة الملوثات إزالة كاملة إلى آثار بيئية سلبية أكثر منها إيجابية، أنه لا يمكن اعتبار هذه التدابير تدابير معقولة لتنظيف وإصلاح البيئة بالمعنى المقصود في المادة 35(ب) من مقرر مجلس الإدارة رقم 7.

Accordingly, the Panel finds that contamination of the Raudhatain and Umm Al-Aish aquifers by oil from damaged oil wells and by sea water used to fight the oil well fires constitutes environmental damage directly resulting from Iraq's invasion and occupation of Kuwait, and a programme to remediate the damage would constitute reasonable measures to clean and restore the environment.
74- وبالتالي، فإن الفريق يرى أن تلوث مستودعات المياه الأرضية في الروضتين وأم العيش بسبب النفط المتسرب من آبار النفط المتضررة ومياه البحر المستخدمة في مكافحة حرائق آبار النفط يشكلان ضرراً بيئياً ناجماً بصورة مباشرة عن غزو العراق واحتلاله للكويت، وأن أي برنامج لإصلاح الضرر يشكل تدابير معقولة لتنظيف وإصلاح البيئة.

Further, paragraphs 34 and 35 of Governing Council decision 7, read together, make it clear that losses or expenses resulting from reasonable measures incurred or to be incurred to clean and restore the environment are eligible for compensation, if damage to the environment is a direct result of, inter alia, " military operations or threat of military action by either side during the period 2 August 1990 to 2 March 1991 " .
كما أن الفقرتين 34 و35 من مقرر مجلس الإدارة رقم 7 إذا ما ربطا معاً توضحان أن الخسائر أو التكاليف المترتبة على التدابير المعقولة المتكبدة لتنظيف وإصلاح البيئة قابلة للتعويض، إذا كان الضرر بالبيئة ناشئاً بين أمور أخرى - عن " عمليات عسكرية أو تهديد باتخاذ إجراءات عسكرية من أي من الجانبين في الفترة من 2 آب/أغسطس 1990 إلى 2 آذار/مارس 1991 " .
