UNICEF noted that in 2011 the African Committee of Experts on the Rights and Welfare of the Child had found Kenya to be in violation of the rights of Nubian children to non-discrimination, to nationality and to the prevention of statelessness.

The Committee recommends that the State party continue its cooperation with the African Committee of Experts on the Rights and Welfare of the Child of the African Union towards the implementation of the Convention, the African Charter on the Rights and Welfare of the Child and other human rights instruments, both in the State party and in other African Union member States.
66- توصي اللجنة الدولة الطرف بأن تواصل تعاونها مع لجنة الخبراء الأفريقية المعنية بحقوق الطفل ورفاهه التابعة للاتحاد الأفريقي، وذلك من أجل تنفيذ الاتفاقية والميثاق الأفريقي لحقوق الطفل ورفاهه والصكوك الأخرى المتعلقة بحقوق الإنسان، سواء في الدولة الطرف أو غيرها من الدول الأعضاء في الاتحاد الأفريقي.

Julia Sloth-Nielsen, Dean of the Faculty of Law at the University of the Western Cape and member of the African Committee of Experts on the Rights and Welfare of the Child, said that on the African continent the majority of children grew up under the umbrella of customary law systems, with justice administered by elders and chiefs.
