The systematic denial of human rights in Iraq had resulted in an all-pervasive order of repression and oppression, and nothing had been done to improve its appalling human rights record.
٢٣ - وأضاف قائلا إن اﻹنكار المستمر لحقوق اﻹنسان في العراق أدى إلى نظام شامل من القمع والاضطهاد، ولم يتخذ أي إجراء لتحسين سجله المروع في مجال حقوق اﻹنسان.

9. Aside from the matters addressed below, it is again to be observed that there are no signs of improvement in the general situation of human rights in Iraq.
٩ - وفضلا عن اﻷمور التي يرد تناولها أدناه، يلاحظ مرة أخرى أنه لا توجد حتى اﻵن أي علامات تحسن في الحالة العامة لحقوق اﻹنسان في العراق.

He concluded that there has been essentially no improvement in the situation of human rights in Iraq, and that the absence of respect for the rights pertaining to democratic governance is at the root of all the major violations of human rights in Iraq insofar as that absence implies a structure of power which is autocratic and accountable only to itself, thus inherently resting on the denial and repression of fundamental rights.
وقد خلص إلى أنه لم يحدث أساساً أي تحسن في حالة حقوق اﻹنسان في العراق وأن الافتقاد إلى احترام الحقوق المتعلقة بنظام الحكم الديمقراطي هو السبب الجذري لجميع الانتهاكات الرئيسية لحقوق اﻹنسان في العراق من حيث أن هذا الافتقاد يعني ضمناً وجود هيكل للسلطة يتسم بأنه مطلق وليس مسؤولاً أمام أحد سوى نفسه، ومن ثم فإنه يقوم بشكل متأصل على إنكار الحقوق اﻷساسية وقمعها.

Unfortunately, these accusations were seized upon by Mr. Max van der Stoel, Special Rapporteur on the situation of human rights in Iraq, and included in his report submitted to the Third Committee of the General Assembly on 8 November 1994 (A/49/651).
ولﻷسف فقد تلقف هذه الاتهامات المقرر الخاص لحقوق اﻹنسان في العراق السيد ماكس فان ديرشتول وضمنها في تقريره المقدم الى الجمعية العامة/اللجنة الثالثة في ٨/١١/١٩٩٤ )الوثيقة (A/49/651.

In paragraph 21 of the report, the Special Rapporteur states: " Nor has there been a significant change in any of the structures of the State which the Special Rapporteur believes are the cause of widespread and systematic violations of human rights in Iraq " .
ففي الفقرة )١٢( من التقرير يشير المقرر الخاص " إلى أنه لم يطرأ أي تغيير يذكر على أي من هياكل الدولة التي يعتقد بأنها سبب انتهاكات واسعة ومنهجية لحقوق اﻹنسان في العراق " .

It is striking that ever since he first assumed the title of a special rapporteur on human rights in Iraq, Mr. van der Stoel has conducted himself in a manner that is far from objective and impartial; he has adopted an antagonistic position towards Iraq by failing to observe the need to rely on dependable or accurate sources, convey information carefully and ascertain its veracity, acting instead at the political level.
ان الملفت للنظر ان السيد فان درشتويل تصرف منذ بداية تسميته مقررا خاصا لحقوق اﻹنسان في العراق بشكل بعيد عن الموضوعية والحيادية، واتخذ موقفا معاديا من العراق، ليس على صعيد التصرف الفني المتعلق بضرورة الاعتماد على مصادر يعَوّل عليها أو توخى الدقة والحرص في نقل المعلومات والتأكد من صحتها بل على المستوى السياسي.

CEDAW noted the establishment of the High Commission for Human Rights of Iraq.
10- لاحظت اللجنة المعنية بالقضاء على التمييز ضد المرأة إنشاء المفوضية العليا لحقوق الإنسان في العراق.

44. In December 2008, the Parliament of Iraq approved a law establishing the High Commission for Human Rights of Iraq.
