The Committee recommends that the State party envisage undertaking a comprehensive reform of the Juvenile Offender Act in the spirit of the Convention, in particular articles 37, 39 and 40, and of other United Nations standards in this field, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty.
٤٢٢ - وتوصي اللجنة بأن تفكر الدولة الطرف في إجراء إصلاح شامل لقانون اﻷحداث الجانحين تمشيا مع روح الاتفاقية، وخاصة المواد ٣٧ و ٣٩ و ٤٠، ومع معايير اﻷمم المتحدة اﻷخرى في هذا الميدان، مثل " قواعد بكين " ، و " مبادئ الرياض التوجيهية " ، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

The Committee further recommends that the law reform to be undertaken in this field adequately reflect the provisions of the Convention as well as other relevant international standards, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
وتوصي اللجنة كذلك بأن يعكس الاصلاح القانوني المقرر الاضطلاع به في هذا الميدان بما فيه الكفاية أحكام الاتفاقية وكذلك المعايير الدولية ذات الصلة، مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

5. United Nations Rules for the Protection of Juveniles Deprived of their Liberty, adopted by the General Assembly in resolution 45/113 of 14 December 1990
٥ - قواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم، التي اعتمدتها الجمعية العامة في قرارها ٤٥/١١٣ المؤرخ ١٤ كانون اﻷول/ديسمبر ١٩٩٠

The Committee recommends that the appropriate amendments be made to the Juveniles Act No. 31 of 1974 to adequately reflect the provisions of the Convention as well as other international standards in this field, such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
وتوصي اللجنة بادخال تعديلات مناسبة على قانون اﻷحداث رقم ٣١ لعام ١٩٧٤ بحيث يتم عكس أحكام الاتفاقية بصورة كافية وكذلك تعديل المعايير الدولية اﻷخرى في هذا الميدان، مثل قواعد بيجينغ، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

48. The Committee is concerned about the compatibility of the juvenile justice system in the State party with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٨٤- واللجنة تجد مدعاة للقلق من حيث مدى تمشي قضاء اﻷحداث في الدولة الطرف مع المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع المعايير اﻷخرى ذات الصلة مثل قواعد بيجين ومبادئ الرياض التوجيهية وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

63. The Committee recommends that the State party envisage undertaking further measures to ensure the full compatibility of the juvenile justice system with the Convention, especially articles 37, 40 and 39, and other United Nations standards in this field such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٣٦- وتوصي اللجنة بأن تتوخى الدولة الطرف اتخاذ مزيد من التدابير لضمان المواءمة التامة بين نظام قضاء اﻷحداث والاتفاقية، وخاصة المواد ٧٣ و٠٤ و٩٣، ومعايير اﻷمم المتحدة اﻷخرى في هذا الميدان مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

83. The administration of juvenile justice, and in particular its compatibility with articles 37, 40, and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, is a matter of concern to the Committee.
٣٨- ومن دواعي قلق اللجنة مسألة إدارة قضاء اﻷحداث، وعلى اﻷخص مدى تمشيها مع المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع المعايير اﻷخرى ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

125. While the Committee takes note that the administration of juvenile justice is regulated by the Juvenile Act, it is concerned about the full compatibility of this legislation with articles 37, 40 and 39 of the Convention as well as other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٥٢١- وإذ تعلم اللجنة بأن إدارة قضاء اﻷحداث ينظمها قانون اﻷحداث، فإنها تشعر بالقلق بصدد مطابقة التشريع المطابقة الكاملة للمواد ٧٣ و٠٤ و٩٣ من الاتفاقية فضلاً عن المعايير اﻷخرى مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

173. The situation in relation to the administration of juvenile justice and its compatibility with the principles and provisions of the Convention, in particular articles 37, 40 and 39, as well as other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty is a matter of concern to the Committee.
٣٧١- ومن القضايا التي تقلق اللجنة الوضع فيما يتعلق بإدارة شؤون قضاء اﻷحداث، ومدى تمشيها مع مبادئ الاتفاقية وأحكامها، ولا سيما المواد ٧٣ و٠٤ و٩٣ فضلاً عن المعايير اﻷخرى ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

194. The Committee recommends that the State party envisage undertaking a review of the system of juvenile justice in light of the principles and provisions of the Convention and of other United Nations standards in this field such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٤٩١- وتوصي اللجنة الدولة الطرف بالنظر في مراجعة أوضاع نظام قضاء اﻷحداث على ضوء مبادئ الاتفاقية وأحكامها وغيرها من معايير اﻷمم المتحدة في هذا المجال، مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

117. With regard to the juvenile justice system in the State party, the Committee is concerned about its lack of full compatibility with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.
٧١١- وفيما يتعلق بنظام قضاء اﻷحداث في الدولة الطرف، تشعر اللجنة بالقلق إزاء عدم التوافق التام لهذا النظام مع أحكام المواد ٧٣ و٠٤ و٩٣ من الاتفاقية ومع سائر المعايير ذات الصلة مثل قواعد بيجين، ومبادئ الرياض التوجيهية، وقواعد اﻷمم المتحدة لحماية اﻷحداث المحرومين من حريتهم.

The United Nations Rules for the Protection of Juveniles Deprived of their Liberty were adopted by the General Assembly in its resolution 45/113. They advocate the least possible use of deprivation of liberty, especially in prison and other closed institutions.
٣٣ - اعتمدت الجمعية العامة في قرارها ٥٤/٣١١ قواعد اﻷمم المتحدة لحماية اﻷحداث المجردين من حريتهم وتطالب بأقل استخدام ممكن للحرمان من الحرية لا سيما في السجن والمؤسسات المغلقة اﻷخرى .

The State party should take the necessary steps to protect juveniles from breaches of the Convention, and ensure the proper functioning of a juvenile justice system in compliance with international standards.
ينبغي للدولة الطرف أن تتخذ الخطوات اللازمة لحماية الأحداث من التعرض لأفعال تشكل انتهاكات للاتفاقية وأن تضمن حسن أداء نظام قضاء الأحداث، امتثالاً للمعايير الدولية.

The law establishing legal regulations for the protection of minors provided for the establishment of independent judicial bodies and the adoption of protective measures to promote the rehabilitation and social reintegration of minors.
