2. An international organization incurs international responsibility if it authorizes a member State or international organization to commit an act that would be internationally wrongful if taken by the former organization directly, or if it recommends such an act, provided that:
2 - تتحمل المنظمة الدولية المسؤولية الدولية إذا أذنت لدولة عضو أو منظمة دولية بارتكاب عمل يكون عملا غير مشروع دوليا لو قامت به المنظمة الأولى مباشرة، أو إذا أوصت بذلك العمل، شريطة:

(a) It authorizes a member State or international organization to commit an act that would be internationally wrongful if committed by the former organization and would circumvent an international obligation of the former organization, or recommends that a member State or international organization commit such an act; and
(أ) أذنت لدولة عضو أو منظمة دولية بارتكاب فعل يكون غير مشروع دولياً إذا ارتكبته المنظمة الأولى ويكون التفافاً على التزام دولي يقع عليها، أو إذا أوصت بقيام دولة عضو أو منظمة دولية بارتكاب هذا الفعل؛

(8) Paragraph 2 considers the case in which an international organization circumvents one of its international obligations by recommending to a member State or international organization the commission of a certain act or by authorizing a member State or international organization to commit such an act.
(8) وتبحث الفقرة 2 الحالة التي تلتف فيها منظمة دولية على أحد التزاماتها الدولية بأن توصي دولة عضواً أو منظمة دولية أخرى بارتكاب فعل معين، أو بأن تأذن لدولة عضو أو منظمة دولية أخرى بارتكاب هذا الفعل.

(8) Paragraph 2 covers the case in which an international organization circumvents one of its international obligations by authorizing a member State or international organization to commit a certain act or by recommending to a member State or international organization the commission of such an act.
8) وتبحث الفقرة 2 الحالة التي تلتف فيها منظمة دولية على أحد التزاماتها الدولية بأن تأذن لدولة عضو أو منظمة دولية أخرى بارتكاب فعل معين بأن توصي دولة عضواً أو منظمة دولية أخرى بارتكاب هذا الفعل.

A certificate of non-profit and/or tax-exempt status of the organization issued by a Government authority of a member State or of a non-member observer State of the United Nations, one of its specialized agencies, the International Atomic Energy Agency or a State party to the International Court of Justice.
(ب) شهادة وضع المنظمة كمنظمة لا ربحية و/أو معفاة من الضرائب صادرة عن السلطة الحكومية لدولة عضو أو دولة غير العضو تتمتع بصفة مراقب في الأمم المتحدة، أو في واحدة من وكالاتها المتخصصة، أو في الوكالة الدولية للطاقة الذرية، أو دولة طرف في محكمة العدل الدولية.

Neither ECB, participating national central banks, nor any member of their decision-making bodies is allowed to seek or take instructions from community institutions or bodies, from any Government of a member State or from any other body (article 107 of the Maastricht Treaty).

2- يقرر، في ضوء التجارب المتصلة باستعراضات النظراء الطوعية التي أجراها الأونكتاد وغيره من كيانات حتى الآن، ووفقاً للموارد المتاحة، أنه ينبغي أن يُجري الأونكتاد استعراضاً إضافياً طوعياً للنظراء بشأن قوانين وسياسات المنافسة لدولة عضو أو لتجمع إقليمي من الدول خلال الدورة الرابعة عشرة لفريق الخبراء الحكومي الدولي؛

Decides that UNCTAD should, in light of the experiences with the voluntary peer reviews undertaken so far by UNCTAD and others and in accordance with available resources, undertake a further voluntary peer review on the competition law and policy of a member State or regional grouping of States during the thirteenth session of the Intergovernmental Group of Experts;
