8. As a general rule, in dealing with situations of arbitrary deprivation of liberty within the meaning of paragraph 15 of resolution 1997/50, the Working Group shall refer, in the discharge of its mandate, to the following three legal categories:

The authority of the Guiding Principles has more recently been reaffirmed in General Assembly resolution 66/165, which welcomes their increasing promotion and application, and encourages all relevant actors to make use of them when dealing with situations of internal displacement, including development partners and individual States in the development of domestic legislation and policies.

8. As a general rule, in dealing with situations of arbitrary deprivation of liberty within the meaning of paragraph 15 of resolution 1997/50, the Working Group shall refer, in the discharge of its mandate, to the following five legal categories:

Pursuant to paragraph 8 (c) of its revised methods of work, in dealing with situations of arbitrary deprivation of liberty, the Working Group shall consider the cases where the total or partial non-observance of the international norms relating to the right to a fair trial is of such gravity as to give the deprivation of liberty an arbitrary character.
43- عملاً بالفقرة 8(ج) من إجراءات عمل الفريق العامل المنقحة لدى معالجة حالات الحرمان التعسفي من الحرية، ينظر الفريق في الحالات التي يكون فيها عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة من الخطورة بحيث يضفي على الحرمان من الحرية طابعاً تعسفياً.
