At the end of the additional period for fulfilling commitments, the following additions to the assigned amount pursuant to Article 3, paragraphs 7 and 8, of a Party shall be made in accordance with Article 3, paragraphs 3, 4, 10, 12 and 13, for the accounting of the compliance assessment for the commitment period:

Parties will be required to prohibit and/or restrict the use of harmful anti-fouling systems on ships flying their flag, on ships not entitled to fly their flag but which operate under their authority and on all ships that enter a port, shipyard or offshore terminal of a Party.

In particular, the types of " steps to put an end to the violation " are not specified or de-limited: thus, the Article VIII language could be interpreted very broadly, and potentially in a way contrary to the national security interests of a Party to this Treaty.

7.5 The Committee recalled that, in accordance with the general rules of international law, a treaty does not have retroactive effect whereby it could bind a Party with respect to any act or event which took place, or any situation which ceased to exist, before its entry into force for the State party concerned, unless provided otherwise in the treaty.

12. 45- يُقرر، فيما يخص فترة الالتزام الثانية، ألا تتجاوز الكميات المُضافة إلى الكمية المُخصصة لطرف من الأطراف والكميات المطروحة منها الناتجة عن الاتجار بالانبعاثات والآليات القائمة على مشاريع ما نسبته 30 في المائة من الالتزام الكمي لذلك الطرف بتحديد الانبعاثات وخفضها.
