Every publication of ideas based on racial superiority or hatred, incitement to racial discrimination, and also organized propaganda activities which promote and incite to racial discrimination, shall be deemed a criminal offence punishable by law.

On the other hand, article 4 of the Convention provides that States parties are to " declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred incitement to racial discrimination. "

25. Article 4 (a) of the International Convention on the Elimination of All Forms of Racial Discrimination provides that States parties shall declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred, as well as incitement to racial discrimination.
25 - تنص المادة 4 (أ) من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري على أنه يتعين على الدول الأطراف اعتبار كل نشر للأفكار القائمة على التفوق العنصري أو الكراهية العنصرية، وكذلك كل تحريض على التمييز العنصري، جريمة يعاقب عليها القانون.

14. CERD reiterated its concern at the absence of domestic legislation defining as an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, and racially motivated violence against indigenous people and people of African descent.

The Committee, while noting the State party's efforts to prohibit, through legislation, all dissemination of ideas based on racial superiority or hatred and incitement to racial hatred, reminds the State party of its obligation under article 4 to prohibit all organizations and activities, including those of the mass media, which promote and incite racial discrimination.
