Pursuant to paragraph 2, if a Contracting State which makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, it may at its option consider the Convention as the legal basis for extradition in respect of the offence, subject to the other conditions provided by its law.

It also recommends that the State party ensure that its legislation on extradition be in compliance with article 5 of the Optional Protocol, which should be used, when necessary, as a legal basis for extradition with respect to the offences listed therein.
كما توصي اللجنة الدولة الطرف بضمان امتثال تشريعاتها بشأن التسليم لأحكام المادة 5 من البروتوكول الاختياري التي ينبغي اتخاذها، عند الاقتضاء، أساساً قانونياً للتسليم فيما يتعلق بالجرائم الواردة في البروتوكول الاختياري.

The Parties to the present Protocol which do not make extradition conditional on the existence of a treaty shall henceforth recognize the offences referred above as cases for extradition between themselves.
