The Commission might wish to adopt a standard similar to the one contained in article 8 of the Optional Protocol for the triggering of an inquiry (the receipt of " reliable information indicating grave or systematic violations ... of rights set forth in the Convention " ).

22. The Committee also took decisions relating to its work on submissions received under article 8 of the Optional Protocol alleging grave or systematic violations of rights set forth in the Convention (inquiry procedure), including regarding the publication of the report of an inquiry and to establish, within existing resources, a working group on inquiries under the Optional Protocol.
22 - واتخذت اللجنة أيضا قرارات تخصّ عملها المتعلق بالبلاغات المقدمة بموجب المادة 8 من البروتوكول الاختياري التي تدّعي وقوع انتهاكات خطيرة أو منهجية للحقوق المنصوص عليها في الاتفاقية (إجراء التحري)، بما في ذلك ما يتعلق بنشر التقارير عن التحريات، وبإنشاء فريق عامل، في حدود الموارد المتاحة، يُعنى بالتحريات بموجب البروتوكول الاختياري.

If the Committee is satisfied that the information received is reliable and appears to indicate grave or systematic violations of rights set forth in the Convention or in the substantive Optional Protocols thereto by the State party concerned the Committee shall invite the State party, through the Secretary-General, to cooperate in the examination and, to this end, to submit observations without delay with regard to the information concerned.
1- إذا اقتنعت اللجنة بموثوقية المعلومات الواردة، وبأنها تفيد على ما يبدو بارتكاب الدولة الطرف المعنية انتهاكات جسيمة أو منتظمة للحقوق المنصوص عليها في الاتفاقية أو في البروتوكولين الاختياريين الموضوعيين الملحقين بها، تدعو اللجنة الدولة الطرف، عن طريق الأمين العام، إلى التعاون معها في بحث الموضوع، وتقديم ملاحظات بشأن المعلومات المعنية دون تأخير من أجل ذلك الغرض.

While article 10.1 continues by stating that the information would need to indicate “a serious and/or systematic violation by a State party to the Protocol of rights set forth in the Convention”, article 20.1 of CAT requires that such information must appear to the Committee to “contain well-founded indications that torture is being systematically practised in the territory of a State Party”.

Furthermore, the right to be heard at the international level would further enhance the promotion and protection of the rights enshrined in the Convention.
