It has a particular meaning, which is well understood as containing four elements, namely (a) such activities are not prohibited by international law; (b) such activities involve a risk of causing significant harm; (c) such harm must be transboundary; and (d) the transboundary harm must be caused by such activities through their physical consequences.
وهي تحمل معنى محدداً يفهم منه تماماً أنه يتضمن أربعة عناصر هي: (أ) القانون الدولي لا يحظر هذه الأنشطة؛ (ب) وتنطوي هذه الأنشطة على خطر إحداث ضرر ذي شأن؛ (ج) ولا بد أن يكون هذا الضرر عابراً للحدود؛ (د) ولا بد للضرر العابر للحدود من أن يكون ناشئاً عن هذه الأنشطة من خلال نتائجها المادية().

That obligation could be supplemented by guidance in the form of principles, but the obligation should be spelled out as such so as to ensure that innocent victims of transboundary damage were not left uncompensated.
