As a result, the buyer did not give notice of lack of conformity within the 50-day deadline, but the court found that the buyer had a reasonable excuse for the delay and applied article 44 to permit the buyer to reduce the price of the goods pursuant to article 50 of the Convention.

12. The non-conformity of the goods has to be determined according to article 35 which includes the delivery of defective goods, of different goods (aliud), defects in packaging, and deficiencies in quantity.
