١ - لا يشكل فعل الدولة غير المطابق لما يتطلبه منها التزام دولي انتهاكا لهذا الالتزام إلا إذا جرى القيام بهذا الفعل في وقت كان فيه الالتزام نافذا إزاء تلك الدولة.

“3. If an act of the State which is not in conformity with what is required of it by an international obligation has a continuing character, there is a breach of that obligation only in respect of the period during which the act continues while the obligation is in force for that State.
٣ - إذا كان لفعل الدولة غير المطابق لما يتطلبه منها التزام دولي طابع استمراري، لا يكون هناك انتهاك لهذا الالتزام إلا بشأن الفترة التي يستمر خلالها الفعل بينما يكون الالتزام نافذا إزاء تلك الدولة.

If an act of the State which is not in conformity with what is required of it by an international obligation is composed of a series of actions or omissions in respect of separate cases, there is a breach of that obligation if such an act may be considered to be constituted by the actions or omissions occurring within the period during which the obligation is in force for that State.
٤ - إذا كان فعل الدولة غير المطابق لما يتطلبه منها التزام دولي يتألف من سلسلة أعمال أو امتناعات عن أعمال تتصل بحالات منفصلة، يكون هناك انتهاك لهذا الالتزام إذا جاز اعتبار هذا الفعل مشكلا من اﻷعمال أو الامتناعات عن اﻷعمال الواقعة خلال الفترة التي يكون فيها الالتزام نافذا إزاء تلك الدولة.
