5-6- وتدحض صاحبة البلاغ إدّعاء الدولة الطرف بأن هذا البلاغ لا يشكل ظروفاً استثنائية تستدعي تطبيق أحكام الاتفاقية خارج حدود الولاية القضائية، وتكرر القول بأنها تعرضت للاغتصاب على يد مجموعة من الرجال الذين تعتقد بأنهم كانوا أعضاء في " الإمبيراكوري " وهي ميليشيا شبابية مدعومة من الحزب الحاكم، وأنها تخشى أن تتعرض لنفس المعاملة إذا أعيدت إلى بلد منشئها.
