56. " Sendero Luminoso " has been compared by leading international political analysts with the tragic Pol Pot regime in Cambodia.
٦٥- ويقارن كبار المحللين السياسيين الدوليين عصابة " سنديرو لومينوزو " بنظام كولبوت البشع في كمبوديا.

The author states that at the time when Sendero Luminoso started its terrorist acts in the region, she and her family, being supporters of the legal Communist Party, were accused of having committed acts of terrorism.
فمقدمة البلاغ تقول إنه حينما بدأت منظمة سينديرو لومينوزو أعمالها اﻹرهابية في المنطقة، وجه إليها هي وأسرتها، لكونهم من أنصار الحزب الشيوعي المشروع، الاتهام بارتكاب أعمال إرهابية.

Adding the author’s own statement that her family reported her abduction by the Sendero Luminoso to the police, there is nothing to indicate that the authorities were particularly interested in her or her relatives in Peru.
وإذا ما أضيف إلى ذلك قول مقدمة البلاغ نفسها إن أسرتها أبلغت الشرطة باختطاف منظمة سينديرو لومينوزو لها، لا يتبقى أي شيء يدل على أن السلطات كانت مهتمة على نحو خاص بها أو بأقربائها في بيرو.

On the morning of 19 August 1993, a group of Sendero Luminoso terrorists murdered 55 members of the Ashaninka community living in settlements in the Mazamarí Valley, in the Province of Satípo, Department of Junín.
قامت مجموعة من اﻹرهابيين التابعين لسنديرو لومينوزو بقتل ٥٥ من أهالي مجتمع اﻷشانينكا في قرى وادي مازاماري بولاية ساتيبو، مقاطعة جونين، فجر يوم ١٩ آب/اغسطس ١٩٩٣.

3.1 The author considers that there exists a substantial risk for her to be subjected to torture both by Sendero Luminoso and the State authorities, for which internal flight is no safe solution.
٣-١ ترى مقدمة البلاغ أنها معرضة لخطر كبير مؤداه التعذيب من جانب كل من منظمة سينديرو لومينوزو وسلطات الدولة، ومن ثم فإن النزوح الداخلي ليس حلا مأمونا.

However, the State party’s view in the present case is that, even if there is a risk of persecution from Sendero Luminoso, it is of local character and the author could therefore secure her safety by moving within the country.
بيد أن رأي الدولة الطرف في الحالة الراهنة، هو أنه حتى إذا كان خطر الاضطهاد من جانب منظمة سينديرو لومينوزو قائما، فإنه ذو طابع محلي ومن ثم يمكن لمقدمة البلاغ أن تؤمﱢن سلامتها بالانتقال إلى مكان آخر داخل البلد.

5.4 Counsel refutes the argument of an existing internal flight alternative, since the author has seen the faces of the members of Sendero Luminoso who abducted and raped her and for that reason is not safe anywhere in the country.
٥-٤ ويدحض محامي الدفاع الحجة القائلة بوجود رحلة طيران داخلية بديلة، نظرا ﻷن صاحبة البلاغ رأت وجوه أعضاء منظمة سنديرو لومينوزو الذين اختطفوها واغتصبوها، ولهذا السبب لا يوجد أي مكان آمن في البلد.

Paradoxically, the new democratic regime appeared at the same time as the first terrorist action by " Sendero Luminoso " .
ومن التناقضات الظاهرة أن النظام الديمقراطي الجديد ظهر في نفس الوقت مع أول عملية ارهابية قامت بها " سنديرو لومينوزو " .

55. From 1989 onwards, however, " Sendero Luminoso " considered it had secured a so-called " strategic balance " with the State forces and decided to begin a new stage by aggravating social contradictions.

During this period, just over 400 local leaders were the victims of the actions of the Sendero Luminoso.
وخلال هذه الفترة، كان أكثر من ٠٠٤ من القادة المحليين ضحية أعمال منظمة " سينديرو لومينوزو " .

On 27 January 1994, the Swedish Immigration Board rejected her application, considering that there were no indications that she was persecuted by the Peruvian authorities, and that the acts by Sendero Luminoso could not be considered as persecution by authorities, but criminal activities.
وفي ٢٧ كانون الثاني/يناير ١٩٩٤، رفض مجلس الهجرة السويدي طلبها، بالنظر إلى أنه لا توجد دلائل على تعرضها للاضطهاد من جانب السلطات البيروية، وأن اﻷعمال التي ارتكبتها منظمة سينديرو لومينوزو لا يمكن اعتبارها اضطهادا من جانب السلطات بل تعتبر أنشطة إجرامية.

The Aliens Appeals Board rejected the author’s appeal on 8 June 1995, adding that the risk of persecution from non-governmental entities like Sendero Luminoso could in exceptional cases constitute a ground for granting refugee status, but that in an internal flight alternative existed in the author’s case.
وفي ٨ حزيران/يونيه ١٩٩٥ رفض مجلس التماسات اﻷجانب الالتماس المقدم من مقدمة البلاغ، مضيفا أن خطر الاضطهاد من الكيانات غير الحكومية مثل منظمة سينديرو لومينوزو يمكن في حالات استثنائية أن يشكل مبررا لمنح مركز اللاجئ، ولكن بديل النزوح الداخلي متوفر في حالة مقدمة البلاغ.

3.2 The author further claims that, in view of her fragile psychiatric condition and the severe post-traumatic stress disorder from which she is suffering as a result of her having been raped by Sendero Luminoso members, the deportation as such would constitute a violation of article 16 of the Convention.
٣-٢ وتدعي مقدمة البلاغ كذلك أنه بالنظر إلى حالتها السيكولوجية الهشة وشدة ما تعاني منه من الاعتلال اﻹجهادي التالي للصدمة نتيجة لقيام الفردين التابعين لمنظمة سينديرو لومينوزو باغتصابها، فإن الترحيل على هذا النحو سيشكل انتهاكا للمادة ١٦ من الاتفاقية.

4.9 As to the current general situation of human rights in Peru, the State party reiterates that for members of Sendero Luminoso, the Movimiento Revolucionario Túpac Amaru (MRTA) or similar terrorist organizations who are wanted by the Peruvian authorities, the risk of torture or ill-treatment cannot be disregarded.
٤-٩ وفيما يتعلق بالحالة العامة الراهنة لحقوق اﻹنسان في بيرو، تكرر الدولة الطرف التنبيه إلى أن خطر التعرض للتعذيب أو إساءة المعاملة أمر لا يمكن إغفاله بالنسبة إلى أعضاء منظمة سينديرو لومينوزو أو حركة تورباك آمارو الثورية أو المنظمات اﻹرهابية المماثلة الذين تلاحقهم السلطات البيروية.

On 8 June 1995, the Aliens Appeals Board maintained that no sufficient grounds for asylum existed on account of risk for persecution from the Peruvian authorities, adding that as to the threat from Sendero Luminoso, this was considered to be of local character and an internal flight alternative would therefore be possible.
وفي ٨ حزيران/يونيه ١٩٩٥، أكد مجلس التماسات اﻷجانب أنه لا توجد مبررات كافية لمنح اللجوء بسبب خطر التعرض للاضطهاد من جانب السلطات البيروية، وأضاف إلى ذلك أن الخطر الذي تمثله منظمة سينديرو لومينوزو يعتبر ذا طابع محلي ومن ثم فإن النزوح الداخلي بديل ممكن.
