Together with other countries in the region, Brazil had engaged in a four-year consultative process which had led to the elaboration of the draft United Nations guidelines for the Appropriate Use and Conditions of Alternative Care for Children, which had been adopted by consensus by the Human Rights Council at its eleventh session (resolution 11/7).

At its thirty-eighth session, held from 10 to 28 January 2005, the Committee on the Rights of the Child adopted a decision entitled " Children without parental care " ,1 in which it recommended that the Commission on Human Rights consider establishing, at its sixty-first session in 2005, a working group to prepare draft United Nations guidelines for the protection and alternative care of children without parental care.
