2.2 On 7 August 2001, the Tashkent Regional Court found the author's son guilty of fraud, robbery, and murder and sentenced him to death.
2-2 وبتاريخ 7 آب/أغسطس 2001، قررت محكمة طشقند الإقليمية أن ابن صاحبة البلاغ مذنب بتهم الغش والسطو والقتل العمد، وحكمت عليه بالإعدام.

At the time of submission of the communication, both alleged victims were on death row, after having been sentenced to capital punishment, on 23 December 2002, by the Tashkent Regional Court.
وكانت الضحيتان المزعومتان، وقت تقديم البلاغ، بانتظار تنفيذ حكم الإعدام الذي أصدرته بحقهما محكمة طشقند الإقليمية في 23 كانون الأول/ديسمبر 2002.

4. On 31 March 2003, the State party noted that on 23 December 2002, the Tashkent Regional Court found Mr. A. Isaev and Mr. N. Karimov guilty under articles 97 and 164 of the Uzbek Criminal Code and sentenced them to death penalty.

2.7 On 24 July 1999, the Tashkent Regional Court sentenced five out of eight co-defendants, including Uigun and Oibek Ruzmetov, to death.

However, the Committee noted that in this case, the burden of proof whether the confession was voluntary was on the accused, and both the Tashkent Regional Court and the Supreme Court ignored the allegations of torture made by the author's sons.

She indicates, however, that information provided by the Tashkent Regional Court contradicts information which she received on an unspecified date from the Yunusabad District Bureau of the Civilian Registry Office (ZAGS), an agency responsible for maintaining records of the death of individuals, confirming that no official record about the death of Uigun and Oibek Ruzmetov had been received in 1999-2000.

In this regard she points to the discrepancy between the records of the Tashkent Regional Court and the records of the Yunusabad District Bureau of the Civilian Registry Office (ZAGS) (see paras. 1.3 and 2.9 above).

On 19 December 2003, the State party submitted that Uigun and Oibek Ruzmetov had been tried and found guilty by the Tashkent Regional Court on 29 June 1999 of a variety of crimes under the Criminal Code of Uzbekistan.

The author asked for explanations and was informed, by letter of 22 January 2001, that when her son received a copy of the judgement of the Tashkent Regional Court of 26 December 2001, he was duly informed of his right to request a presidential pardon and of the right to be assisted by a lawyer when preparing this request.
وطلبت صاحبة البلاغ تفسيراً لذلك، فأُخبرت بخطاب بتاريخ 22 كانون الثاني/يناير 2001، أنه عندما تلقى ابنها نسخةً من حكم محكمة طشقند الإقليمية الصادر بتاريخ 26 كانون الأول/ديسمبر 2001، أُعلِم على النحو الواجب بحقه في طلب عفوٍٍِِ رئاسي وفي الحصول على مساعدة من محامٍ لإعداد الطلب.

4. The State party presented its comments on 22 May 2002. It recalls that the author's son's guilt was established and he was correctly sentenced to death on 7 August 2001, by the Tashkent Regional Court.
4- قدمت الدولة الطرف ملاحظاتها بتاريخ 22 أيار/مايو 2002؛ حيث أشارت إلى أن إدانة ابن صاحبة البلاغ قد ثبتت، وأن حكم الإعدام الذي أصدرته بحقه محكمة طشقند الإقليمية بتاريخ 7 آب/أغسطس 2001 كان حكماً صحيحاً.

2.5 On 18 September 2001, the Tashkent Regional Court found Agabekov and his co-accused guilty of committing a premeditated attack, acting in a group, and murdering the two individuals to take over their possessions, under aggravating circumstances, and of illegal acquisition and storage of heroin.

4.2 On 12 November 2001, the Tashkent Regional Court re-qualified the crimes in relation to the murders, but maintained the death sentences.
