4 - ينتخب أعضاء اللجنة بواسطة الدول الأطراف مع مراعاة التوزيع الجغرافي العادل، وتمثيل مختلف أشكال الحضارات والأنظمة القانونية الرئيسية، والتمثيل المتوازن للجنسين، ومشاركة الخبراء المعوقين.

4. The members of the Committee shall be elected by States Parties, consideration being given to equitable geographical distribution, representation of the different forms of civilization and of the principal legal systems, balanced gender representation and participation of experts with disabilities.

68. The representative of Italy made a statement in relation to article 6, paragraph 4. She expressed her firm opinion that the reference in this paragraph to “the representation of different forms of civilization” was unsuitable for the following reasons.
٨٦- وألقت ممثلة إيطاليا بياناً يتصل بالفقرة ٤ من المادة ٦، فأعربت عن رأيها الراسخ أن الاشارة في هذه الفقرة إلى " وتمثيل مختلف أشكال الحضارات " غير ملائمة لﻷسباب التالية.

4. In the election of the members of the Sub-Committee, eligible for election in accordance with article 4, consideration shall be given to equitable geographical distribution of membership, to a proper balance among the various fields of competence referred to in article 4 and to the representation of different forms of civilization and of the principal legal systems.
٤- عند انتخاب أعضاء اللجنة الفرعية، المؤهلين للانتخاب وفقا للمادة ٤، يراعى التوزيع الجغرافي العادل للعضوية، وتحقيق توازن مناسب بين شتى ميادين الاختصاص المشار إليها في المادة ٤، وتمثيل مختلف أشكال الحضارات والنظم القانونية اﻷساسية.

71. The representative of Canada stated that her delegation wished to associate itself with the comments of the delegation of Chile and indicated that her delegation had not opposed the use of the phrase “the representation of different forms of civilization” in article 6, paragraph 4, in the drafting group as the discussion had shown that it was important for some delegations.
١٧- وقالت ممثلة كندا إن وفدها يود تأييد تعليقات وفد شيلي وأشارت إلى أن وفدها لم يعارض استعمال عبارة " وتمثيل مختلف أشكال الحضارات " في الفقرة ٤ من المادة ٦، في فريق الصياغة، إذ بينت المناقشة أن هذه العبارة مهمة بالنسبة لبعض الوفود.

72. The delegation of Colombia considered that the reference in article 6, paragraph 4 “the representation of different forms of civilization” was not only unnecessary but also constituted a dangerous precedent in the universal conception of the human rights, considering that gross human rights violations often took place using as a pretext the necessity of defending particular forms of civilization.
٢٧- واعتبر وفد كولومبيا أن اﻹشارة في الفقرة ٤ من المادة ٦ " وتمثيل مختلف أشكال الحضارات " ليست فقط غير ضرورية وإنما تشكل أيضاً سابقة خطيرة في التصور العالمي لحقوق اﻹنسان، باعتبار أنه كثيرا ما تقع انتهاكات جسيمة لحقوق اﻹنسان بحجة ضرورة الدفاع عن أشكال معينة من الحضارات.

4. In the election of the members of the Sub-Committee, primary consideration shall be given to the fulfilment of the requirements and criteria of article 4. Furthermore, due consideration shall be given to a proper balance among the various fields of competence referred to in article 4, to equitable geographical distribution of membership and to the representation of different forms of civilization and legal systems of the States parties.
٤- عند انتخاب أعضاء اللجنـة الفرعيـة، يُولى اعتبـار أساسي لاستيفاء شـروط ومعايير المادة ٤، وبالاضافة إلى ذلك، يُولى الاعتبار الواجب لتوازن مناسب بين شتى ميادين الاختصاص المشار إليها في المادة ٤، وللتوزيع الجغرافي العادل للعضوية، وتمثيل مختلف أشكال الحضارات والنظم القانونية في الدول اﻷطراف.

However, she wished to state clearly her delegation's view that the use of “civilization” in that paragraph referred only to the selection of members of the sub-committee and in no way suggested that torture could be viewed differently through the lens of culture or “of different forms of civilization”, or that its use for the purposes of selection could affect the work of the sub-committee.
غير أن ممثلة كندا أعربت عن رغبتها في إعلان رأي وفدها بوضوح وهو أن استعمال كلمة " الحضارات " في تلك الفقرة يُشير فقط إلى اختيار أعضاء اللجنة الفرعية ولا يوحي بأي حال بإمكانية رؤية العذاب بطريقة مختلفة من خلال عدسة الحضارة أو " مختلف أشكال الحضارات " ، أو بأن استعمال العبارة ﻷغراض الاختيار قد يؤثر على عمل اللجنة الفرعية.

“The delegation of Colombia considered that the reference in article 6, paragraph 4, to'the representation of different forms of civilization'was not only unnecessary but constituted a harmful precedent in the universal and holistic conception of human rights, if it was borne in mind that, under the pretext of defending particular forms of civilization, human rights were in many cases flagrantly and continuously violated.
