State Parties that have used our abandoned cluster munitions which have become cluster munition remnants located in areas under jurisdiction or under control of another State Party are STRONGLY ENCOURAGED to provide assistance to the latter State Party to facilitate the marking, clearance and destruction of such cluster munition remnants.

11. `Cluster munition contaminated area'means an area known or suspected to contain cluster munition remnants.
11- يُقصد ﺑ `المنطقة الملوثة بالذخائر العنقودية` منطقةٌ يعرف أنها تحتوي على مخلفات ذخائر عنقودية أو يشتبه في أنها تحتوي على هذه المخلفات.

Different considerations and processes will be required for the release of land contaminated by a mix of cluster munition remnants and mines and/or other explosive remnants of war (ERW).

4- بعد بدء نفاذ هذا البروتوكول، ومتى أصبحت الذخائرُ العنقودية مخلفات ذخائر عنقودية موجودة في مناطق مشمولة بولاية أحد الأطراف المتعاقدة السامية أو خاضعة لسيطرته، يقدم كل طرف من الأطراف المتعاقدة السامية لديه القدرة اللازمة مساعدة طارئة على وجه الاستعجال إلى الطرف المتعاقد السامي المتأثر.

6 - عندما تصبح الذخائر العنقودية، بعد دخول هذه الاتفاقية حيز النفاذ، مخلفات ذخائر عنقودية واقعة في مناطق مشمولة بولاية دولة طرف أو خاضعة لسيطرتها، تقوم كل دولة طرف في وضع يتيح لها تقديم المساعدة بتوفير المساعدة الطارئة على وجه السرعة للدولة الطرف المتضررة.

(b) Sources of Evidence: All available sources of evidence should be investigated when conducting a non-technical survey of a suspected contamination of cluster munition remnants.

4. Where, after entry into force of this Protocol, cluster munitions have become cluster munition remnants located in areas under the jurisdiction or control of a High Contracting Party, each High Contracting Party in a position to do so shall urgently provide emergency assistance to the affected High Contracting Party.
4- بعد بدء نفاذ هذا البروتوكول، ومتى أصبحت الذخائرُ العنقودية مخلفات ذخائر عنقودية موجودة في مناطق مشمولة بولاية أحد الأطراف المتعاقدة السامية أو خاضعة لسيطرته، يقدم كل طرف من الأطراف المتعاقدة السامية، متى كان في وضع يمكنه من ذلك، مساعدة طارئة على وجه الاستعجال إلى الطرف المتعاقد السامي المتأثر.

4. This paragraph shall apply in cases in which cluster munitions have been used or abandoned by one State Party prior to entry into force of this Convention for that State Party and have become cluster munition remnants that are located in areas under the jurisdiction or control of another State Party at the time of entry into force of this Convention for the latter.
4 - تسري هذه الفقرة على الحالات التي تستعمل فيها دولة طرف الذخائر العنقودية أو تهجرها قبل دخول هذه الاتفاقية حيز النفاذ بالنسبة لهذه الدولة الطرف وتصبح فيها تلك الذخائر مخلفات ذخائر عنقودية واقعة في مناطق مشمولة بولاية دولة طرف أخرى أو خاضعة لسيطرتها وقت دخول هذه الاتفاقية حيز النفاذ بالنسبة لتلك الدولة الطرف الأخيرة.
