The right of an assignee in an assigned receivable and its proceeds has priority over the right of an insolvency administrator and creditors who obtain a right in the assigned receivable or its proceeds by attachment, judicial act or similar act of a competent authority that gives rise to such right, if the receivable was assigned before the commencement of such insolvency proceeding, attachment, judicial act or similar act.
تكون لحق المحال اليه في المستحق المحال وعائداته أولوية على حق مدير الاعسار والدائنين الذين يحصلون على حق في المستحق المحال أو عائداته عن طريق الحجز أو أمر قضائي أو أمر مماثل يصدر عن هيئة مختصة ويُنشئ هذا الحق، اذا كان المستحق قد أحيل قبل استهلال اجراءات الاعسار تلك أو ذلك الحجز أو الأمر القضائي أو الأمر المماثل.

If, under that law, priority is based on the time of notification, an assignee cannot obtain priority over the creditors of the assignor or the insolvency administrator.
أما اذا كانت الأولوية، بموجب ذلك القانون، تستند إلى وقت الاشعار، فلا يمكن للمحال اليه أن يحصل على الأولوية على دائني المحيل أو مدير الاعسار.

In the case of insolvency proceedings commenced in a jurisdiction other than that in which the assignor was located, it was noted that the basic approach of draft article 24 was to preserve, to a large extent, the rights of the insolvency administrator and of the assignor’s creditors existing under law applicable outside the draft Convention.
وفي حالة اجراءات الاعسار التي يشرع بها في ولاية قضائية غير الولاية القضائية التي يقع فيها مقر المحيل ، لوحظ أن النهج اﻷساسي لمشروع المادة ٤٢ هو المحافظة ، الى حد كبير ، على حقوق مدير الاعسار ودائني المحيل الموجودين بموجب قانون واجب التطبيق خارج نطاق مشروع الاتفاقية .

28. Another major issue was that of conflicts of priority among several claimants of the same receivables, either among several assignees of the same receivables from the same assignor or between assignees and creditors of the assignor or the insolvency administrator.
٨٢- وقال ان ثمة مسألة رئيسية أخرى، وهي تنازع اﻷولويات فيما بين عدة مطالبين بنفس المستحقات، اما بين عدة أطراف تحال اليهم نفس المستحقات من جانب نفس المحيل أو بين المحال اليهم وبين مقرضي المحيل أو مدير الاعسار.

" (5) Except as provided in this article, this Convention does not affect the rights of the insolvency administrator or the rights of the assignor's creditors.
" )٥( باستثناء ما هو منصوص عليه في هذه المادة ، لا تمس هذه الاتفاقية حقوق مدير الاعسار أو حقوق دائني المحيل .

With such an approach, while article 26, paragraph 2, would apply in general, its real impact would be limited to conflicts between an assignee of the receivable claiming the account as proceeds and creditors of the assignor or the insolvency administrator.
16- وبمثل هذا النهج نجد أنه بينما تنطبق المادة 26، الفقرة 2، بصفة عامة، سيقتصر تأثيرها الفعلي على المنازعات بين الشخص المحال اليه المستحق الذي يطالب بالحساب باعتباره عائدات من جهة ودائني المحيل أو مدير الاعسار من جهة أخرى.
