As to the final form of work on the topic, his delegation still believed that it should be a set of draft articles, rather than principles, that would complete the draft articles on prevention already adopted by the Commission and that could, in due course, lay the groundwork for an international convention on liability in the case of transboundary harm arising out of hazardous activities.

Draft principle 1 basically embraced the same four criteria for identifying activities falling within the scope of the draft principles as had been employed in the draft articles on the prevention of transboundary harm from hazardous activities: the element of human causation, the element of risk, the element of extra-territoriality and the physical element.
