In agreeing that the draft articles should reflect customary international law, the view was expressed that despite significant improvements in the text, certain provisions continued to deviate from customary international law and could be better aligned with international practice, namely, those relating to countermeasures, serious breaches of essential obligations to the international community, and the definition of an " injured State " .
