It was pointed out that solutions to the treatment of corporate groups in insolvency could not be reached by way of a definition, nor should that definition lead to legal consequences.

The Working Group commenced its consideration of the treatment of enterprise groups in insolvency at its thirty-first session (Vienna, 11-15 December 2006) on the basis of a note by the Secretariat covering both domestic and international treatment of enterprise groups (A/CN.9/WG.V/WP.74 and Add.1 and 2). It continued that consideration at its thirty-second to thirty-eighth sessions, in 2007 to 2010, respectively.

79. Australia appreciated the Commission's work on the treatment of corporate groups in insolvency and supported further development of the UNCITRAL Legislative Guide on Insolvency Law to address the issue.

Concerning insolvency law, Japan expected that Working Group V would continue its efforts towards ensuring the smooth and efficient disposition of insolvency and promoting its legal predictability through a careful examination of the treatment of corporate groups in insolvency.
