3. The procuring entity may, in the first stage, engage in discussions with suppliers or contractors whose initial tenders have not been rejected pursuant to provisions of this Law concerning any aspect of their initial tenders.
3- يجوز للجهة المشترية، في المرحلة الأولى، أن تجري مناقشات مع المورِّدين أو المقاولين الذين لم تُرفض عطاءاتهم الأولية بمقتضى أحكام هذا القانون، بشأن أيٍّ من جوانب تلك العطاءات.

Since the dialogue normally involves complex and time-consuming procedures, the method should not be used for simple items that are usually procured through procurement methods not involving interaction with suppliers or contractors.
ونظراً لأنَّ الحوار ينطوي عادة على إجراءات معقّدة وتستغرق وقتاً طويلاً، فينبغي ألاّ تُستخدم هذه الطريقة للأصناف البسيطة التي تُشترى في العادة بواسطة طرائق اشتراء لا تنطوي على تفاعل مع المورِّدين أو المقاولين.

In order to use request-for-proposals-with-dialogue proceedings, the procuring entity would have to conclude therefore that formulating a complete single set of terms and conditions of the procurement would not be possible or would not be appropriate, and therefore dialogue with suppliers or contractors is necessary for the procurement to succeed.
ولكي تتمكن الجهة المشترية من استخدام إجراءات طلب الاقتراحات المقترن بحوار، عليها أن تخلص إلى أنَّ صياغة مجموعة كاملة واحدة من شروط الاشتراء وأحكامه أمر متعذّر أو غير مناسب، مما يقتضي إجراء حوار مع المورِّدين أو المقاولين حتى تنجح عملية الاشتراء.

4. The procurement regulations, in the context of paragraph (4) of the article, should clarify that the provisions do not prevent the procuring entity from addressing at the meeting with suppliers or contractors any requests for clarification of the solicitation documents submitted to it either before or at the meeting, and its responses thereto.
4- وينبغي أن توضح لوائح الاشتراء، في سياق الفقرة (4) من هذه المادة، أن الأحكام لا تمنع الجهة المشترية من أن تتناول في الاجتماع المعقود مع المورِّدين أو المقاولين أي طلبات لإيضاح وثائق الالتماس تكون قد قدِّمت إليها سواء قبل الاجتماع أو في أثنائه، وردودها على تلك الطلبات.

(3) The procuring entity may, in the first stage, engage in discussions with suppliers or contractors whose tenders have not been rejected pursuant to provisions of this Law, concerning any aspect of their tenders.
(3) يجوز للجهة المشترية، في المرحلة الأولى، أن تجري مناقشات مع المورِّدين أو المقاولين الذين لم تُرفض عطاءاتهم بمقتضى أحكام هذا القانون، بشأن أيٍّ من جوانب تلك العطاءات.
