B. Procedure for determining admissibility of communications

4.1 On 4 October 2011, the State party submitted a " background memorandum on the inadmissibility of communications submitted to the Human Rights Committee in connection with the implementation of the Charter for Peace and National Reconciliation " in which it contested the admissibility of the communication.
4-1 في 4 تشرين الأول/أكتوبر 2011، أحالت الدولة الطرف مذكرة تحت عنوان " المذكرة المرجعية للحكومة الجزائرية بشأن عدم مقبولية البلاغات الفردية المقدمة إلى اللجنة المعنية بحقوق الإنسان فيما يتعلق بتنفيذ ميثاق السلم والمصالحة الوطنية " اعترضت فيها على مقبولية البلاغ.

4.1 On 29 May 2009, the State party contested the admissibility of the communication in a " background memorandum on the inadmissibility of communications submitted to the Human Rights Committee in connection with the implementation of the Charter for Peace and National Reconciliation " .

By failing to accept the competence of the Committee to determine whether a communication shall be registered and by declaring beforehand that it would not accept the determination of the Committee on the admissibility and on the merits of the communications, the State party violates its obligations under article 1 of the Optional Protocol to the Covenant.

Communications received before the new rules of procedure came into force will be dealt with under the old rules, according to which admissibility is considered at the first stage.
