28. Effective legal aid includes, but is not limited to, unhindered access to legal aid providers for detained persons, confidentiality of communications, access to case files and adequate time and facilities to prepare their defence.

legal aid providers representing children should be trained in and be knowledgeable about children's rights and related issues, receive ongoing and indepth training and be capable of communicating with children at their level of understanding.

37. States should put in place mechanisms to ensure that all legal aid providers possess education, training, skills and experience that are commensurate with the nature of their work, including the gravity of the offences dealt with, and the rights and needs of women, children and groups with special needs.
37 - ينبغي للدول أن تضع آليات لضمان حصول جميع مقدمي المساعدة القانونية على التعليم والتدريب والمهارات والخبرات الملائمة لطبيعة عملهم ولمسائل منها خطورة الجرائم التي يتعاملون معها وحقوق النساء والأطفال والفئات ذات الاحتياجات الخاصة واحتياجاتهم.

(b) To facilitate access for legal aid providers assigned to provide assistance to detained persons in police stations and other places of detention for the purpose of providing that assistance;
(ب) تيسير الوصول إلى مقدمي المساعدة القانونية المكلفين بتقديم المساعدة إلى الأشخاص المحتجزين في مراكز الشرطة وغيرها من أماكن الاحتجاز بغرض تقديم تلك المساعدة؛

(b) Ensure that legal aid providers are subject to applicable professional codes of conduct, with appropriate sanctions for infractions;
(ب) ضمان خضوع مقدمي المساعدة القانونية لمدونات قواعد السلوك المهنية المعمول بها، مع تطبيق جزاءات ملائمة على أي مخالفات ترتكب؛

65. The Special Rapporteur encourages States to recognize and support the contribution of non-State actors in providing legal aid, and recommends that they adopt all appropriate measures to ensure that non-State legal aid providers are able to carry out their work effectively, freely, autonomously and independently, and without any intimidation, harassment or improper interference.
65- وتحث المقررة الخاصة الدول على الإقرار بمساهمة الفاعلين غير الحكوميين في تقديم المساعدة القانونية ودعم هذه المساهمة، وتوصيها بأن تتخذ جميع التدابير المناسبة لتمكين مقدمي المساعدة القانونية غير الحكوميين من القيام بعملهم بفعّالية وحرية واستقلالية ودون تبعية، وفي ظروف خالية من التخويف أو التحرش أو التدخل غير المناسب.

(g) Mechanisms and procedures are established to ensure close cooperation and appropriate referral systems between legal aid providers and other professionals (i.e., health, social and child welfare providers) to obtain a comprehensive understanding of the victim, as well as an assessment of his or her legal, psychological, social, emotional, physical and cognitive situation and needs.
(ز) وضع آليات وإجراءات لضمان التعاون الوثيق وتشغيل نظم الإحالة الملائمة بين مقدمي المساعدة القانونية والمهنيين الآخرين (أي مقدمي الخدمات الصحية والاجتماعية ورعاية الطفل) لاكتساب فهم شامل عن الضحايا، إلى جانب تقييم حالتهم واحتياجاتهم القانونية والنفسية والاجتماعية والعاطفية والبدنية والمعرفية.

(e) Establishing mechanisms and procedures to ensure close cooperation and appropriate referral systems between legal aid providers and different professionals to obtain a comprehensive understanding of the child, as well as an assessment of his or her legal, psychological, social, emotional, physical and cognitive situation and needs.
(ﻫ) إرساء آليات وإجراءات لضمان التعاون الوثيق وتطبيق نظم الإحالة الملائمة بين مقدمي المساعدة القانونية ومختلف الاختصاصيين لاكتساب فهم شامل عن الأطفال، وتقييم حالتهم واحتياجاتهم القانونية والنفسية والاجتماعية والعاطفية والبدنية والمعرفية.
