2.1 The author is a Falun Gong practitioner and originates from Fuqing in Fujian province of China.

The Tribunal was not satisfied that the complainant was a Falun Gong practitioner, because the complainant's claims lacked details in important aspects.

With regard to his practice of Falun Gong in Australia, the Committee notes that the State party has accepted that the author was practising Falun Gong and had basic notions of the movement; however, it concluded that the author's practice was of private and limited scope and has not raised any suspicion of the Chinese authorities.
أما فيما يتعلق بممارسته الفالون غونغ في أستراليا، تلاحظ اللجنة أن الدولة الطرف قد سلمت بأن صاحب البلاغ هو فعلاً من ممارسي الفالون غونغ وأنه على اطلاع على المبادئ الأساسية للحركة؛ غير أنها تعتبر أن صاحب البلاغ يمارس الفالون غونغ على أساس شخصي وفي نطاق محدود ولم يثر أي شبهة حوله لدى السلطات الصينية.

25. The Committee is deeply concerned at the continuous violations of the rights of and discrimination against Tibetan and Uighur children and children of Falun Gong practitioners in mainland China, including their right to freedom of religion, language and culture.
25- يساور اللجنة قلق عميق إزاء تواصل انتهاكات حقوق الأطفال التبتيين والويغور وأطفال ممارسي الفالون غونغ والتمييز ضدهم في الصين القارية، بما في ذلك حقهم في حرية الدين واللغة والثقافة.

2.2 The complainant claims that, on 15 August 2001, he was arrested and detained by the police in Fuqing City Detention Centre because he was a Falun Gong group leader and had organized Falun Gong practitioners to protest against the detention of one of their members.
2-2 ويدعي صاحب الشكوى أن الشرطة ألقت القبض عليه في 15 آب/ أغسطس 2001 واحتجزته في " سجن مدينة فوتشينغ " لأنه كان قائد إحدى مجموعات الفالون غونغ وقد نظّم عدداً من ممارسي الفالون غونغ بغية الاحتجاج على احتجاز أحد أعضائهم.

In his application he alleged that he had started practicing Falun Gong in 1995, became a teacher in his area and that in 2001 he had been arrested, detained and tortured for two weeks, after organizing a group of practitioners to seek the release of other detained Falun Gong practitioners.
وادعى صاحب الشكوى في طلبه أنه بدأ يمارس الفالون غونغ عام 1995 ثم صار معلماً في منطقته فألقي القبض عليه عام 2001 واحتُجز وعُذب لأسبوعين عقب تنظيمه مجموعة من ممارسي الفالون غونغ سعت إلى إطلاق سراح محتزين آخرين من ممارسي الفالون غونغ.

The report also states that neighbourhood groups were reportedly instructed to report on Falun Gong members, and refers to several cases in which Falun Gong practitioners had been arrested and disappeared and to one case where a practitioner, sentenced to internment in a camp, had been tortured.
ويذكر التقرير أيضاً روايات تفيد أن مجموعات الأحياء تلقت توجيهات بالإبلاغ عن أعضاء الفالون غونغ، ويشير إلى عدة حالات توقيف واختفاء طالت أفراداً من ممارسي الفالون غونغ وإلى حالة واحدة جرى فيها تعذيب أحد الممارسين المحكوم عليه بالاحتجاز في معسكر.

In the light of the above, the Committee cannot conclude that the information before it shows that the author would face a real risk of treatment contrary to article 7 of the Covenant as a Falun Gong practitioner if he were removed to China.
وفي ضوء ما تقدم، لا يمكن للجنة أن تخلص إلى أن المعلومات المعروضة عليها تكشف أن صاحب البلاغ سيواجه خطراً حقيقياً للتعرض لمعاملة منافية لأحكام المادة 7 من العهد في حالة ترحيله إلى الصين، بصفته من ممارسي الفالون غونغ.

The Tribunal decided that the complainant's claims about being a Falun Gong practitioner and having a well-founded fear of persecution in China were not credible.
وقرّرت أنّ لا مصداقية لادعاءات صاحب الشكوى بأنه أحد ممارسي الفالون غونغ وبأن لديه خوفاً مبرراً من التعرض للاضطهاد في الصين.

Specifically, the Tribunal did not accept that the applicant was a Falun Gong practitioner or that he had received adverse attention from Chinese authorities as a result of his activities.
