وينبغي أن يقوم اختيار الإجراء المناسب على أساس القرار المبدئي الذي اتخذته السلطة المتعاقدة بشأن ما إذا كان سيتسنى تنفيذ المشروع بدون استخدام عملية أو تصميم أو منهجية أو مفهوم هندسي يمتلك مقدم الاقتراح أو شركاؤه حقوقا حصرية فيها.

104. However, a somewhat different situation may arise if the uniqueness of the proposal or its innovative aspects are such that it would not be possible to implement the project without using a process, design, methodology or engineering concept for which the proponent or its partners possess exclusive rights, either worldwide or regionally.
104- بيد أنه يمكن أن ينشأ وضع مختلف بعض الشيء إذا كان الطابع الفريد للاقتراح أو لجوانبه المبتكرة بحيث يستحيل معه تنفيذ المشروع بدون استخدام عملية أو تصميم أو منهجية أو مفهوم هندسي يملك فيها مقدم الاقتراح أو شركاؤه حقا حصريا، عالميا كان أو إقليميا.

That the contracting authority should use a procedure for obtaining elements of comparison for the unsolicited proposal if it appears that the innovative aspects of the proposal are such that it would not be possible to implement the project without using a process, design, methodology or engineering concept for which the proponent or its partners possess exclusive rights;
)أ( أن تستخدم الهيئة المتعاقدة اجراءات تمكنها من الحصول على عناصر مقارنة للاقتراح غير الملتمس اذا تبين أن الجوانب المبتكرة للاقتراح تجعل من غير الممكن تنفيذ المشروع بدون استخدام عملية أو تصميم أو منهجية أو مفهوم هندسي يمتلك مقدم الاقتراح أو شركاؤه حقوقا حصرية فيها ؛

However, a somewhat different situation may arise if the uniqueness of the proposal or its innovative aspects are such that it would not be possible to implement the project without using a process, design, methodology or engineering concept for which the proponent or its partners possess exclusive rights, either worldwide or regionally.
٦١١ - بيد أنه يمكن أن ينشأ وضع مختلف بعض الشىء اذا كان الطابع الفريد للاقتراح أو لجوانبه المبتكرة على شكل يستحيل معه تنفيذ المشروع بدون استخدام عملية أو تصميم أو منهجية أو مفهوم هندسي يملك فيها مقدم الاقتراح أو شركاؤه حقا حصريا ، عالميا كان أو اقليميا .

That the contracting authority should initiate competitive selection procedures under recommendations 3 to 22 above if it is found that the implementation of the project is possible without the use of a process, design, methodology or engineering concept for which the proponent or its partners possess exclusive rights or proposed concept or technology is not truly unique or new;
)أ( أن تشرع الهيئة المتعاقدة في اجراءات الاختيار التنافسية بموجب التوصيات من ٣ الى ٢٢ اذا تبين أنه يمكن تنفيذ المشروع بدون استخدام عملية أو تصميم أو منهجية أو مفهوم هندسي يمتلك مقدم الاقتراح أو شركاؤه حقوقا حصرية فيه ، أو بدون أن يكون المفهوم أو التكنولوجيا المقترحان فريدين من نوعهما أو جديدين حقا ؛
