States parties might use the provisions of article 26, paragraphs 2 and 3, of the Organized Crime Convention to secure the testimony of members of an organized criminal group in investigations and prosecutions of cases involving trafficking in persons, for the purpose of prosecuting other members of the organized criminal group.
59- وقد تلجأ الدول الأطراف إلى الاستناد إلى أحكام الفقرتين 2 و3 من المادة 26 من اتفاقية الجريمة المنظّمة لضمان الحصول على إفادات أعضاء جماعة إجرامية منظّمة في التحقيقات في قضايا الاتجار بالأشخاص، وملاحقة المتورطين فيها قضائياً لغرض ملاحقة أعضاء آخرين من الجماعة الإجرامية المنظّمة.

50. The group also expressed concern about the relationship between article 14 of the Organized Crime Convention, on disposal of confiscated proceeds of crime, and chapter V of the United Nations Convention against Corruption, focusing in particular on how States parties to both Conventions should deal with their implementation.
50- وأعرب الفريق أيضا عن قلقه إزاء العلاقة بين المادة 14 من اتفاقية الجريمة المنظّمة المتعلقة بالتصرف في عائدات الجرائم المصادرة والفصل الخامس من اتفاقية الأمم المتحدة لمكافحة الفساد الذي يركّز، بصورة خاصة، على كيفية قيام الدول الأطراف في الاتفاقيتين بتناول تنفيذهما.

Article 34, paragraph 1, of the Organized Crime Convention provides that each State party shall take the necessary measures, including legislative and administrative measures, in accordance with fundamental principles of its domestic law, to ensure the implementation of its obligations under the Convention.
7- وتقضي الفقرة 1 من المادة 34 من اتفاقية الجريمة المنظّمة بأن تتخذ كل دولة طرف ما يلزم من تدابير، بما في ذلك التدابير التشريعية والإدارية، وفقا للمبادئ الأساسية لقانونها الداخلي، لضمان تنفيذ التزاماتها بمقتضى هذه الاتفاقية.

20. Calls upon States parties to consider establishing and maintaining, as appropriate, direct channels of communication between border control agencies, enhancing law enforcement cooperation, strengthening the capacity of law enforcement agencies and taking other measures contemplated in article 27 of the Organized Crime Convention to achieve those goals;
20- يهيب بالدول الأطراف أن تنظر في إنشاء قنوات اتصال مباشرة بين أجهزة مراقبة الحدود والمحافظة على تلك القنوات، حسب الاقتضاء، وتعزيز التعاون في مجال إنفاذ القانون وتدعيم قدرة أجهزة إنفاذ القانون، واتخاذ التدابير الأخرى المتوخّاة في المادة 27 من اتفاقية الجريمة المنظّمة تحقيقا لهذه الأهداف؛

States parties might use the provisions of article 26, paragraphs 2 and 3, of the Organized Crime Convention to secure the testimony of members of an organized criminal group in investigations and prosecutions of cases involving trafficking in persons, for the purpose of prosecuting other members of the organized criminal group.
37- وقد تلجأ الدول الأطراف إلى استخدام أحكام الفقرتين 2 و3 من المادة 26 من اتفاقية الجريمة المنظّمة لضمان الحصول على إفادات أعضاء جماعة إجرامية منظّمة في التحقيقات في قضايا الاتجار بالأشخاص، وملاحقة المتورطين فيها قضائياً لغرض ملاحقة أعضاء آخرين من الجماعة الإجرامية المنظّمة.

50. Article 29, paragraph 1 (h) of the Organized Crime Convention requires States parties to initiate, develop or improve specific training programmes dealing with methods used in combating organized crime committed through the use of computers, telecommunications networks or other forms of modern technology.
50- وتلزم المادة 1 (ح) من المادة 29 من اتفاقية الجريمة المنظّمة الدول الأطراف بأن تعمل على انشاء أو تطوير أو تحسين برامج تدريب خاصة تتناول الطرائق المستخدمة في مكافحة الجريمة المنظّمة التي ترتكب باستخدام الحواسيب أو شبكات الاتصالات السلكية واللاسلكية أو غير ذلك من أشكال التكنولوجيا الحديثة.

(v) Building, based on existing cases and experiences, a matrix identifying legal and practical issues that could arise in the implementation of article 20 of the Organized Crime Convention and the use of special investigative techniques, as well as possible solutions to those issues, including by collecting examples of arrangements or agreements on the use of such techniques between States parties;

In its decision 4/4, the Conference decided to establish an open-ended working group, in accordance with article 32, paragraph 3, of the Organized Crime Convention, and rule 2, paragraph 2, of the rules of procedure for the Conference, to be chaired by a member of the Bureau, in order to advise and assist the Conference in the implementation of its mandate with regard to the Trafficking in Persons Protocol.
2- وقرّر مؤتمر الأطراف، في مقرّره 4/4، إنشاء فريق عامل مفتوح العضوية وفقا للفقرة 3 من المادة 32 من اتفاقية الجريمة المنظّمة والفقرة 2 من المادة 2 من النظام الداخلي للمؤتمر، يرأسه أحد أعضاء مكتب المؤتمر، من أجل إسداء المشورة للمؤتمر وتقديم المساعدة له في تنفيذ الولاية المنوطة به وفقا لبروتوكول الاتجار بالأشخاص.

The information received from responding States on issues related to border control cooperation with other States could further be considered in conjunction with the national replies regarding the implementation of article 27 of the Organized Crime Convention on law enforcement cooperation (see CTOC/COP/2006/2/Rev.1), as well as the implementation of article 11, paragraph 6, of the Trafficking in Persons Protocol (see CTOC/COP/2006/6/Rev.1).
29- علماً بأن المعلومات المتلقّاة من الدول المجيبة عن المسائل ذات الصلة بالتعاون على المراقبة الحدودية مع الدول الأخرى يمكن النظر فيها إضافة إلى ذلك مقترنة بالردود الوطنية الخاصة بتنفيذ المادة 27 من اتفاقية الجريمة المنظّمة عن التعاون على إنفاذ القوانين (انظر الوثيقة CTOC/COP/2006/2/Rev.1)، وكذلك عن تنفيذ الفقرة 6 من المادة 11 من بروتوكول الاتِّجار (انظر الوثيقة CTOC/COP/2006/6/Rev.1).
