وإذا وافقت اﻷمم المتحدة على الفهم الوارد في الفقرات من ١ إلى ٩ أعلاه، تشكل هذه المذكرة وردكم الكتابي اﻹيجابي اتفاقاً بين جمهورية ألمانيا الاتحادية واﻷمم المتحدة بشأن الفهم المذكور أعلاه ويبدأ نفاذه وفقاً للمادة ٧٢ من اتفاق المقر.

Noting that the Federal Republic of Germany has issued an ordinance, which became effective on 23 October 1998, implementing major parts of the Headquarters Agreement under German law, and further noting that article 3, paragraph 3, article 4 and article 5 of the Headquarters Agreement require ratification by the Federal Republic of Germany,

However, the removal of licence plates during the period of their validity would be an enforcement measure and inconsistent with the relevant provisions of article 31 of the Vienna Convention and articles IV and V of the 1946 Convention and article V of the Headquarters Agreement.
على أي حال تعتبر إزالة لوحات التراخيص أثناء فترة صلاحيتها من تدابير الإنفاذ وتتنافى مع الأحكام ذات الصلة في المادة 31 من اتفاقية فيينا والمادتين الرابعة والخامسة من اتفاقية عام 1946 والمادة الخامسة من اتفاق المقر.

In the light of this and on the assumption that there is ample and effective opportunity to contest tickets issued unjustly or in error, it is in my view difficult to conclude that the non-renewal or non-issuance of diplomatic plates in such circumstances violates the general obligations of facilitation set out in article 25 of the Vienna Convention and in section 27 of the Headquarters Agreement.
في ضوء ما تقدم وبفرض وجود فرصة كبيرة وفعالة للاعتراض على المخالفات التي صدرت بشكل مجحف أو على سبيل الخطأ، يتعذر في رأيي أن نخلص إلى أن عدم التجديد أو عدم إصدار لوحات دبلوماسية في مثل هذه الظروف يُعد انتهاكا للالتزامات العامة بتقديم تسهيلات وفقا للمادة 25 من اتفاقية فيينا والمادة 27 من اتفاق المقر.

It is evident that a provision of the nature of section 21 of the Headquarters Agreement cannot require the exhaustion of local remedies as a condition of its implementation. "
ومن البديهي أن لا يستوجب حكم له طابع البند 21 من اتفاق المقر استنفاد وسائل الانتصاف المحلية كشرط لتنفيذه " ().

We would therefore once again urge the host Government to ensure that the OIC Mission is accorded the necessary privileges, as envisaged in Article 105 of the United Nations Charter and in the relevant provisions of the United Nations Headquarters Agreement with the host country.
ولــذا فنحن نحـــث الحكومة المضــيفة مجددا على أن تكفل لبعثة منـــظمة المؤتمر اﻹسلامي الامتيــازات اللازمة وفق ما توخته المادة ١٠٥ من ميثاق اﻷمم المتحدة، واﻷحكام ذات الصلة من اتفاق المقر لﻷمم المتحدة مع البلد المضيف.
