With reference to its general comment No. 8 (2006) on the right of the child to protection from corporal punishment and other cruel or degrading forms of punishment (CRC/C/GC/8), the Committee urges the State party to explicitly prohibit by law corporal punishment in all settings, including in the family, schools and other institutions and childcare settings.
46- واللجنة، إذ تشير إلى تعليقها العام رقم 8(2006) بشأن حق الطفل في الحماية من العقاب البدني وغيره من ضروب العقوبة القاسية أو المهينة (CRC/C/GC/8)، تحث الدولةَ الطرفَ على حظر العقاب البدني قانوناً وبشكل صريح في جميع الحالات، بما في ذلك في الأسرة والمدرسة وغيرهما من المؤسسات وفي مؤسسات الرعاية البديلة.

The Committee recommends that the State party, while taking due account of general comment No. 8 of the Committee on the right of the child to protection from corporal punishment and other cruel or degrading forms of punishment (2006), amend article 234 of the Civil Code and enforce legislation explicitly prohibiting all forms of corporal punishment of children in all settings, including the home.

In light of its general comment No. 8 (2006) on the right of the child to protection from corporal punishment and other cruel or degrading forms of punishment and its previous recommendations (CRC/C/15/Add.178, para. 24(a)), the Committee urges the State party to prohibit corporal punishment of children in all settings, notably in family and in non-institutional childcare settings as a matter of priority.
