Accordingly, the Meeting recommended that specific protection and assistance be provided for persons applying for refugee status and that the principle of non-refoulement be respected, in accordance with article 14 of the Trafficking in Persons Protocol and article 19 of the Migrants Protocol.
ومن ثم، أوصى الاجتماع بتوفير حماية ومساعدة خاصة للأشخاص الذين يطلبون الحصول على مركز اللاجئ، وباحترام مبدأ عدم الإعادة القسرية عملا بالمادة 14 من بروتوكول الاتجار بالأشخاص والمادة 19 من بروتوكول المهاجرين.

Article 6, paragraph 1 (b), of the Migrants Protocol establishes a series of offences related to the use of travel and identity documents for the purpose of enabling the smuggling of migrants.
14- تحدّد الفقرة 1 (ب) من المادة 6 من بروتوكول المهاجرين مجموعة جرائم متعلقة باستخدام وثائق السفر وبطاقات الهوية لغرض تسهيل تهريب المهاجرين.

Since a key aim of the Migrants Protocol is to promote the criminalization of the smuggling of migrants and not migration itself, States parties are required not to subject smuggled migrants to any criminal liability for the fact of having been the object of the criminal conduct described in article 5 of the Protocol.
27- بما أن أحد الأهداف الرئيسية من بروتوكول المهاجرين هو تعزيز تجريم تهريب المهاجرين وليس تجريم الهجرة ذاتها، فالمطلوب من الدول الأطراف الامتناع عن إلقاء أي مسؤولية جنائية على عاتق المهاجرين المهرَّبين لكونهم هدف السلوك الإجرامي المحدد في المادة 5 من البروتوكول.

Almost all States confirmed that their competent authorities enabled the verification of the nationality or right of permanent residence of the smuggled migrants upon request of the receiving State (see art. 18, para. 3, of the Migrants Protocol).
15- وأكّدت جميع الدول تقريبا أن سلطاتها المختصة تتيح إمكانية التحقّق من جنسية المهاجرين المهرَّبين أو حقهم في الإقامة الدائمة بناءً على طلب الدولة المستقبِلة (انظر الفقرة 3 من المادة 18 من بروتوكول المهاجرين).

Most of the responding States reported that their competent authorities had cooperated with relevant international organizations in implementing measures to carry out the return of smuggled migrants (see art. 18, para. 6, of the Migrants Protocol).
19- أبلغ معظم الدول المجيبة بأن سلطاتها المختصة قد رسّخت التعاون مع المنظمات الدولية المعنية على تنفيذ التدابير اللازمة للقيام بإعادة المهاجرين المهرَّبين (انظر الفقرة 6 من المادة 18 من بروتوكول المهاجرين).

Furthermore, the measures set forth in the Protocol are not to be interpreted and applied in a way that is discriminatory to persons on the ground that they are smuggled migrants (see art. 19 of the Migrants Protocol).
علاوة على ذلك، فإن التدابير المبيّنة في البروتوكول لا تُفسّر وتُطبّق على نحو ينطوي على تمييز تجاه الأشخاص بناءً على كونهم مهاجرين مهرَّبين (انظر المادة 19 من بروتوكول المهاجرين).

Almost all responding States replied that they had strengthened border measures in order to prevent and detect the smuggling of migrants (see art. 11, para. 1, of the Migrants Protocol).
