12. While noting that Section 18 of the Constitution of the State party prohibits discrimination of any kind and unfair treatment, the Committee remains concerned at the absence of a specific prohibition of discrimination against women as defined in article 1 of the Convention.
12- إذ تلاحظ اللجنة أن المادة 18 من دستور الدولة الطرف تحظر التمييز مهما كان نوعه كما يحظر المعاملة الجائرة، فإنها تظل قلقة حيال عدم حظر التمييز ضد المرأة على نحو محدّد كما تم تعريفه في المادة 1 من الاتفاقية.

As an automatic consequence of their placement under guardianship, the authors' names were removed from the electoral register, pursuant to article 70, paragraph 5, of the Constitution of the State party that was applicable at the time, which provided that persons placed under total or partial guardianship did not have the right to vote.

12. The Committee notes with appreciation that article 22 of the Constitution of the State party and other legislation guarantee the right to non-discrimination and equality to all citizens.

5. The report notes that article 14 of the Constitution of the State party guarantees the principle of equality and non-discrimination to all its citizens (para. 48).

13. While noting that article 6 of the Constitution of the State party includes a definition of discrimination in conformity with article 1 of the Convention, the Committee is concerned about the fact that the absence of a comprehensive law on gender equality continues to be a challenge for the effective implementation of the principle of non-discrimination and gender equality.
13 - تلاحظ اللجنة أن المادة ٦ من دستور الدولة الطرف تتضمن تعريفاً للتمييز يتوافق مع المادة ١ من الاتفاقية، غير أن القلق يساورها إزاء استمرار عدم وجود قانون شامل عن المساواة بين الجنسين، ما يشكل تحدياً يعرقل التنفيذ الفعال لمبدأ عدم التمييز والمساواة بين الجنسين.

The Committee also notes with concern that the omission of the ground of " sex " among the grounds of non-discrimination in the provisions of article 29 of the Constitution of the State party deprives women of a crucial legal protection against gender-based discrimination (art. 3).
وتلاحظ اللجنة أيضاً بقلق أن إغفال " نوع الجنس " كسبب من أسباب عدم التمييز ضمن أحكام المادة 29 من دستور الدولة الطرف يحرم النساء من حماية قانونية مهمة من التمييز القائم على أساس الجنس (المادة 3).

5. While observing that article 19 of the Constitution of the State party makes reference to a number of human rights treaties, the Committee however notes that the provisions of the Covenant have not been directly applied or invoked by the State party's courts (art. 2).

While the Committee takes note of articles 148 and 151 of the Constitution of the State party, it is concerned that the exact status of the Convention in domestic law remains unclear and regrets the lack of information, including examples, on the application of the Convention's provisions by the domestic courts.
10- مع أن اللجنة تحيط علماً بالمادتين 148 و151 من دستور الدولة الطرف، فإنها تشعر بالقلق إزاء الغموض المحيط بوضع الاتفاقية الحقيقي في القانون الداخلي وهي تأسف لقلة المعلومات المتوفرة بشأن تطبيق محاكم البلد أحكامَ الاتفاقية والأمثلة المقدَّمة على هذا التطبيق.

While noting that article 6 of the Constitution of the State party provides for equality before the law, the Committee regrets that the Constitution does not embody the principle of equality between women and men nor contain a definition of discrimination against women in accordance with article 1 of the Convention.
14- تحيط اللجنة علماً بأن المادة 6 من دستور الدولة الطرف تنص على المساواة أمام القانون، غير أنها تعرب عن الأسف لأن الدستور لا يكرس مبدأ المساواة بين الرجل والمرأة ولا يتضمن أي تعريف للتمييز ضد المرأة وفقاً للمادة 1 من الاتفاقية.

Article 348 of the State Constitution stipulates that no citizen of Myanmar shall be discriminated against on the basis of race, birth, religion, official position and status, culture, gender or wealth.
وتنص المادة 348 من دستور الدولة على عدم ممارسة التمييز في حق أي مواطن لميانمار على أساس العرق أو المولد أو الدين أو المركز أو الصفة الرسمية أو الثقافة أو نوع الجنس أو الثروة.

Section 347 of the State Constitution stipulates that the Union shall guarantee citizens the enjoyment of equal rights before the law and equally provide legal protection.
