It may be desirable to provide in the project agreement that a change in circumstances that justifies a revision of the project agreement must have been beyond the control of the concessionaire and of such a nature that the concessionaire could not reasonably be expected to have taken it into account at the time the project agreement was negotiated or to have avoided or overcome its consequences.

The degree of assistance from the concessionaire needed by the contracting authority with regard to the supply of spare parts and services will depend on the technology and skilled personnel possessed by or available to the contracting authority.
٢٥ - سوف تتوقف درجة المساعدة التي تحتاجها الهيئة المتعاقدة من صاحب الامتياز فيما يتعلق بتوريد قطع الغيار والخدمات على التكنولوجيا التي لدى الهيئة المتعاقدة وعلى الموظفين المهرة المتوافرين لديها .

The contract may also require the concessionaire to furnish “as built” drawings indicating how the various pieces of equipment interconnect and how access can be obtained to them to enable the spare parts to be installed and to enable maintenance and repairs to be carried out.
وقد يطلب العقد أيضا من صاحب الامتياز توفير الرسومات " اﻷصلية " التي تبين كيف تتصل أجزاء المعدات المختلفة ببعضها وكيف يتم الوصول اليها حتى يمكن تركيب قطع الغيار والقيام بعمليات الصيانة والاصلاح .

٤٢ - ويؤدي نوع ونطاق الضمان المقدم من صاحب الامتياز أو من مساهميه دورا جوهريا في الترتيبات التعاقدية الخاصة بتمويل مشاريع البنية التحتية .
