7 - وفيما يتعلق بآثار النزاعات المسلحة على المعاهدات، أعرب عن رأي وفده بأن الموضوع يشكّل جزءاً من قانون المعاهدات وإن كانت له صلات تربطه بالقانون الإنساني الدولي وبحظر استعمال القوة أو التهديد باستعمالها في العلاقات الدولية فضلاً عن المسؤولية الدولية للدول.

" Both these matters may have an impact on the operation of certain parts of the law of treaties in conditions of entirely normal international relations, and the Commission felt that considerations of logic and of the completeness of the draft articles indicated the desirability of inserting a general reservation covering cases of succession and cases of State responsibility.

In relation to articles 17 (1) and (2), it was suggested that it could be made clearer in the commentary that in the event of a breach, the respective provisions of the law of treaties and the law of State responsibility should always be interpreted and applied in concert.

To foster international relations based on the rule of law, all States should have equal opportunity to participate in international law-making processes and should fulfil their obligations under both treaty law and customary international law.
ولتعزيز العلاقات الدولية على أساس سيادة القانون، ينبغي إتاحة فرص متساوية لجميع الدول لتشارك في العمليات الدولية لوضع القانون، كما ينبغي أن تفي بالتزاماتها بموجب كل من قانون المعاهدات والقانون الدولي العرفي.

51. Consequently, the prohibition of arbitrary deprivation of liberty is part of treaty law, customary international law and constitutes a jus cogens norm.

A State that had qualified its consent by entering reservations in accordance with international law thus had no need to subject itself to any conditions, constraints or procedures other than those arising from the law of treaties or the instrument in question.
