هو طريقة اشتراء تُستخدَم كملاذ أخير، وسِمتها المميِّزة الرئيسية هي انتفاء التنافس، لأن الدعوة إلى تقديم عرض أسعار أو اقتراح تُوجَّه إلى مورِّد أو مقاول واحد فقط.

(b) Whether the framework agreement is to be concluded with one or more than one supplier or contractor;
(ب) ما إذا كان الاتفاق الإطاري سوف يُبرم مع مورِّد أو مقاول واحد أو أكثر؛

2. A closed framework agreement with more than one supplier or contractor shall be concluded as one agreement between all parties unless:
2- يُبرَم الاتفاقُ الإطاري المغلق مع أكثر من مورِّد أو مقاول واحد كاتفاق واحد بين جميع الأطراف، إلاَّ في الحالات التالية:

Paragraphs 4 to 6 of article 34 of this Law shall apply to the procedure preceding the solicitation of a proposal or price quotation from a single supplier or contractor.
تسري أحكامُ الفقرات 4 إلى 6 من المادة 34 من هذا القانون على الإجراءات التي تسبق التماس اقتراح أو طلب عروض أسعار من مورِّد أو مقاول واحد.

(d) Whether, in a closed framework agreement concluded with more than one supplier or contractor, there will be a second-stage competition to award a procurement contract under the framework agreement and, if so:
(د) ما إذا كان الاتفاق الإطاري المغلق الذي يبرَم مع أكثر من مورِّد أو مقاول واحد سوف ينطوي على تنافس في مرحلة ثانية من أجل إرساء عقد الاشتراء بمقتضى الاتفاق الإطاري، وإذا كان الأمر كذلك:

(d) Whether in a closed framework agreement concluded with more than one supplier or contractor there will be a second-stage competition to award a procurement contract under the framework agreement and, if so:
(د) ما إذا كان الاتفاق الإطاري المغلق الذي يبرم مع أكثر من مورِّد أو مقاول واحد سوف ينطوي على تنافس في مرحلة ثانية من أجل إرساء عقد الاشتراء بمقتضى الاتفاق الإطاري، وإذا كان الأمر كذلك:

(2) A closed framework agreement with more than one supplier or contractor shall be concluded as one agreement between all parties unless:

They can be concluded only where there is more than one supplier or contractor (although they could theoretically be concluded with one supplier or contractor (which is then invited to improve its offer for a particular purchase under the framework agreement), the Model Law does not allow for such a procedure.
ولا يمكن أن تُبرم إلا عندما يكون هناك أكثر من مورِّد أو مقاول واحد (مع أنها يمكن نظريا أن تُبرم مع مورِّد أو مقاول واحد) (يُدعى بعد ذلك لتحسين عرضه بخصوص مشتريات معيّنة بمقتضى الاتفاق الإطاري)، ولا يسمح القانون النموذجي بإجراء من هذا القبيل.

A balance is needed between evaluation criteria that are so inflexible that there may be effectively only one supplier or contractor at the second stage, with consequential harm to value for money and administrative efficiency, and the use of such broad or vague criteria that their relative weights and the process can be manipulated to favour certain suppliers or contractors.
ومن الضروري أن يكون هناك توازن بين معايير التقييم التي تكون منعدمة المرونة إلى الحد الذي قد لا يوجد معه فعليا سوى مورِّد أو مقاول واحد في المرحلة الثانية، مما يترتب عليه تدنّي القيمة مقابل السعر وانخفاض الكفاءة الإدارية، من جهة واستخدام معايير عامة أو غامضة إلى حد يمكن معه التلاعب بأوزانها النسبية وبالعملية ذاتها لترجيح كفة مورّدين أو مقاولين معيّنين.

The administrative efficiencies of framework agreements tend to indicate that multiple-supplier framework agreements are more commonly appropriate, but the nature of the market concerned may indicate that a single-supplier framework agreement is beneficial (for example, where confidentiality or security of supply is an important consideration, or where there is only one supplier or contractor in the market).
والكفاءة الإدارية للاتفاقات الإطارية تنحو إلى بيان أنَّ الاتفاقات الإطارية المتعدّدة المورِّدين هي الأنسب عموما، ولكن طابع السوق المعنية قد يُبيّن أنَّ اتفاقا إطاريا مع مورِّد واحد مفيد (وذلك، على سبيل المثال، عندما تكون سرّية التوريد أو ضمانه اعتبارا هامّا، أو عندما لا يكون هناك سوى مورِّد أو مقاول واحد في السوق).

Paragraphs (4) to (6) of article 33 of this Law shall apply to the procedure preceding the solicitation of a proposal or price quotation from a single supplier or contractor.
تسري أحكام الفقرات (4) إلى (6) من المادة 33 من هذا القانون على الإجراءات التي تسبق التماس اقتراح أو طلب عروض أسعار من مورِّد أو مقاول واحد.

That approach might enable the procuring entity to maximize economy by procuring either from a single supplier or contractor or from a combination of them, depending on which approach the tenders revealed to be more cost effective.
وقد يمكّن هذا النهج الجهة المشترية من زيادة الميزة الاقتصادية إلى أقصى حدّ باللجوء إلى الاشتراء إما من مورِّد أو مقاول واحد بمفرده وإما من مجموعة منهم، تبعاً للنهج الذي من شأنه أن يظهر أيّ العطاءات هي أكثر جدوى من حيث التكلفة.
