62. In order to cover the costs of the appeal process and deter frivolous appeals, the filing fee for appeals in relation to requests for issuance shall be based on the quantity of emission reductions or removals certified by the DOE in the request for issuance under appeal.

This process appears to be having a positive impact on accountability, as the percentage of contested administrative decisions that were upheld by management evaluation reviews increased from 63 per cent in 2009, when 49 of 78 contested decisions were upheld, to 93 per cent in 2011, when 168 of 180 contested decisions were upheld.

In respect of the 126 evaluation letters issued during the period, the Advisory Committee was informed that the managerial decision being contested was upheld by the Under-Secretary-General for Management in 93 cases (74 per cent), overturned in 14 cases (11 per cent) and partially upheld in 19 cases (15 per cent).
