4. For the purposes of paragraph 1 of this article and article 9 of this Convention, " public official " shall mean a public official or a person who provides a public service as defined in the domestic law and as applied in the criminal law of the State Party in which the person in question performs that function.

(b) The promising, offering or granting, directly or indirectly, to a public official or a person who performs public functions, of any article of monetary value or other undue benefit, such as a gift, favour or advantage for himself or herself or for another person or entity, in exchange for any act or omission in the performance of his or her public functions.
(ب) وعد موظف عمومي أو شخص يؤدي وظائف عمومية بأي شيء ذي قيمة نقدية أو منفعة أخرى غير مستحقة، مثل هدية أو فضل أو مزية، أو عرضها عليه أو منحه إياها، بشكل مباشر أو غير مباشر، سواء لصالحه أو لصالح شخص آخر أو كيان آخر، مقابل قيامه أو امتناعه عن القيام بفعل ما لدى أدائه وظائفه العمومية.

(a) The promise, offering or giving to a public official [or a person who performs public functions], directly or indirectly, of an undue advantage, for the official himself or herself or another person or entity, in order that the official act or refrain from acting in the exercise of his or her official duties;

In the judgement, the Chamber stated that " it is difficult to envisage circumstances by which rape, by, or at the instigation of a public official, or with the consent or acquiescence of an official, could be considered as occurring for a purpose that does not, in some way, involve punishment, coercion, discrimination or intimidation.
