According to the provision, when, following a uniting of two or more States, a treaty in force at the date of the succession of States in respect of any of them continued in force in respect of the successor State, only the reservations formulated by the State that was a party to the treaty were considered to be maintained.

Thus, for a treaty that continues in force in respect of a State formed from a uniting of States, it seems logical to consider that only those reservations formulated by the State or States in respect of which the treaty was in force at the date of the union may be maintained.

97. In fact, the same solution should also apply to any reservation formulated by a successor State other than a newly independent State to a treaty which, following the succession of States, continues in force for that State.

Lastly, paragraph 4 indicated that the same solutions could be applied to reservations that had been formulated in respect of a treaty that, on the date of the succession of States, had not been in force for any of the predecessor States but to which one or, depending on the case, two or more of the predecessor States were contracting States.
