2. Each State Party shall take measures to ensure that all authorizations for the export of conventional arms under the scope of this Treaty are detailed and issued prior to the export.
2 - تتخذ كل دولة طرف التدابير اللازمة كي تكون جميع تراخيص تصدير الأسلحة التقليدية التي تقع ضمن نطاق هذه المعاهدة تراخيص مفصلة وصادرة قبل التصدير.

2. Each importing State Party shall put in place adequate measures that will allow them to regulate, where necessary, imports of conventional arms under the scope of this Treaty.
2 - تقوم كل دولة طرف مستورِدة بوضع التدابير المناسبة التي تسمح لها، عند الاقتضاء، بتنظيم واردات الأسلحة التقليدية التي تقع ضمن نطاق هذه المعاهدة.

44. The requesting State Party [or as applicable the Technical Secretariat] is under the obligation to keep the on-site inspection request within the scope of this Treaty and to provide in the inspection request information in accordance with paragraph 47 [on the basis of which a concern has arisen regarding possible non-compliance with this Treaty].

3. This Treaty shall apply to those activities of the international trade in conventional arms set out in articles 5, 6, 7, 8 and 9, hereafter referred to as " transfer " , for the conventional arms covered under the scope of this Treaty.
3 - تنطبق هذه المعاهدة على أنشطة التجارة الدولية في الأسلحة التقليدية المنصوص عليها في المواد 5 و 6 و 7 و 8 و 9، المشار إليها فيما يلي بكلمة " نقل " ، بالنسبة للأسلحة التقليدية التي يشملها نطاق هذه المعاهدة.

2. A State Party shall not authorize any transfer of conventional arms within the scope of this Treaty if the transfer would violate its relevant international obligations, under international agreements to which it is a Party, in particular those relating to the international transfer of, or illicit trafficking in, conventional arms.
2 - لا تأذن الدولة الطرف بأي عملية لنقل أسلحة تقليدية تقع ضمن نطاق هذه المعاهدة إذا كان من شأن هذا النقل أن ينتهك التزامات دولية تقع على عاتق الدولة الطرف بموجب اتفاقات دولية تكون الدولة طرفا فيها، ولا سيما الاتفاقات المتعلقة بالنقل الدولي للأسلحة التقليدية أو الاتجار بها بصورة غير مشروعة.

3. A State Party shall not authorize a transfer of conventional arms within the scope of this Treaty for the purpose of facilitating the commission of genocide, crimes against humanity, war crimes constituting grave breaches of the Geneva Conventions of 1949, or serious violations of common article 3 of the Geneva Conventions of 1949.
3 - لا تأذن الدولة الطرف بأي عملية لنقل أسلحة تقليدية تقع ضمن نطاق هذه المعاهدة لغرض تيسير ارتكاب جريمة الإبادة الجماعية والجرائم المرتكبة ضد الإنسانية وجرائم الحرب التي تشكل مخالفات جسيمة لاتفاقيات جنيف لعام 1949، أو انتهاكات جسيمة للمادة المشتركة 3 لاتفاقيات جنيف لعام 1949.

1. Each exporting State Party shall conduct national assessments, as detailed in paragraphs 1, 2, 3, 4 and 5 of article 4 and taking into account the considerations as detailed in paragraph 6 of article 4, whether to authorize the export of conventional arms under the scope of this Treaty under its jurisdiction.
1 - تجري كل دولة طرف مصدِّرة تقييمات وطنية، على النحو المفصل في الفقرات 1 و 2 و 3 و 4 و 5 من المادة 4 مع مراعاة الاعتبارات الواردة تفصيلا في الفقرة 6 من المادة 4، لتحديد مدى إمكانية الإذن بتصدير أسلحة تقليدية تقع في نطاق هذه المعاهدة وتوجد ضمن ولاية الدولة الطرف.

1. Each State Party shall designate competent national authorities, define their respective duties and responsibilities, and ensure adequate coordination at the national level among those authorities to ensure that a transparent, predictable, and effective national control system exists for authorizing and licensing the export, re-export, manufacture under foreign licence or technology transfer of items under the scope of this Treaty.
1 - تعيِّن كل دولةٍ طرف سلطات وطنية مختصة وتحدد واجبات ومسؤوليات كل منها، وتكفل التنسيق المناسب على الصعيد الوطني بين هذه السلطات لكفالة توفير نظامُ رقابة وطني يتسم بالشفافية والاستقرار والفعالية للإذن والترخيص بتصدير الأصناف المندرجة في نطاق هذه المعاهدة وإعادة تصديرها وتصنيعها بترخيص من جهة أجنبية ونقل التكنولوجيا الخاصة بها.
