The source submits that, since his arrest, Mr. Kyaw Hla Aung:

The deprivation of liberty of Mr. Kyaw Hla Aung is arbitrary, being in contravention of articles 9, 10, 19 and 20 of the Universal Declaration of Human Rights.
سَلْب السيد كياو هلا أونغ حريته إجراء تعسفي ويتعارض والمواد 9 و10 و19 و20 من الإعلان العالمي لحقوق الإنسان.

Such remedy shall include the immediate release of Mr. Kyaw Hla Aung, and adequate compensation to be awarded to him.
وينبغي أن يتضمن ذلك التصحيح الإفراج الفوري عن السيد كياو هلا أونغ وتعويضه تعويضاً كافياً.

The source reports that Mr. Kyaw Hla Aung was arrested at a temporary shelter in Rakhine State on 15 July 2013 by the Myanmar authorities.

According to the source, Mr. Kyaw Hla Aung was not permitted access to a lawyer after his initial arrest.

Mr. Kyaw Hla Aung is reportedly being held in incommunicado detention but the source believes that he might be in the Sittwe prison.
١٠- وأفيد بأن السيد كياو هلا أونغ عُزل في السجن، لكن المصدر يظن أنه محبوس في سجن سيتوي.

The source further reports that the United Nations Special Rapporteur on the human rights situation in Myanmar was able to visit Mr. Kyaw Hla Aung on 13 August 2013.
١٢- ويفيد المصدر أيضاً بأن مقرر الأمم المتحدة الخاص المعني بحالة حقوق الإنسان في ميانمار تمكن من زيارة السيد كياو هلا أونغ في 13 آب/أغسطس 2013.

The Special Rapporteur noted that a number of political prisoners remained incarcerated in Myanmar and reportedly called on the National President to ensure that Mr. Kyaw Hla Aung was released in the next release planned for political prisoners by the end of 2013.

Kyaw Hla Aung is a national of Myanmar, a human rights lawyer and a respected Muslim community leader from the Arakanese, or Rohingya, community.
٣- كياو هلا أونغ مواطن ميانماري، ومحام يشتغل بحقوق الإنسان، وأحد الزعماء الموقرين لطائفة الروهنجيا المسلمين في ولاية أراكان.

The source is unaware whether a warrant was shown for Mr. Kyaw Hla Aung's arrest and is therefore unaware of the legal basis relied upon at the time.
٧- ولا يدري المصدر ما إذا كان أُبرز للسيد كياو هلا أونغ أمر القبض أم لا؛ وهو من ثم لا يعرف الأساس القانوني الذي استُند إليه في ذلك الحين.

The source submits that the arrest and continued detention of Mr. Kyaw Hla Aung are in breach of the following provisions of the Universal Declaration of Human Rights:
١٥- ويؤكد أيضاً أن القبض على السيد كياو هلا أونغ واستمرار احتجازه يخلاّن بالأحكام التالية من الإعلان العالمي لحقوق الإنسان:

Furthermore the Working Group holds the view that the health condition of Mr. Kyaw Hla Aung associated with his age aggravates the abuse of rights in his case.
٢٤- ويرى الفريق العامل أن حالة السيد كياو هلا أونغ الصحية، مقترنةً بكونه طاعناً في السن، تفاقم انتهاك الحقوق في هذه القضية.

(g) Release Tun Aung and Kyaw Hla Aung, who have been arbitrarily detained since June 2012 and July 2013 respectively, from Sittwe prison, immediately and without conditions;
(ز) إطلاق سراح تون أونغ كياو هلا أونغ المحتجزين بصورة تعسفية منذ حزيران/يونيه 2012 و تموز/يوليه 2013 على التوالي، من سجن سيتوي، فورا ودون شروط؛

The source reports that Mr. Kyaw Hla Aung was forced to go into hiding, even though he had been attempting to find a peaceful solution to the controversy over the census by trying to encourage dialogue between the community leaders and the Myanmar authorities.
٥- وأفاد بأن الحكومة ردت على ذلك بالقبض على قادة الروهنجيا المعروفين واحتجازهم تعسفاً، وبأن السيد كياو هلا أونغ اضطُر إلى الاختباء رغم محاولته إيجاد حل سلمي للخلاف على التعداد بتشجيعه الحوار بين قادة الروهنجيا وسلطات ميانمار.

In the light of the foregoing, the source submits that Mr. Kyaw Hla Aung's deprivation of liberty may be considered arbitrary under categories II and III of the legal categories referred to by the Working Group when considering cases submitted to it.
١٧- وفي ضوء ما تَقدّم، يؤكد المصدر أن سلب حرية السيد كياو هلا أونغ قد يُعَدّ تعسفياً بمقتضى الفئتين الثانية والثالثة من الفئات القانونية التي يستند إليها الفريق العامل عند النظر في القضايا المعروضة عليه.

On 25 June 2014, the Working Group communicated the allegations of the source to the Government of Myanmar, requesting it to provide the Working Group with detailed information about the current situation of Mr. Kyaw Hla Aung and to clarify the legal provisions regarding his arrest and continued detention.
١٨- في 25 حزيران/يونيه 2014، أحال الفريق العامل ادعاءات المصدر إلى حكومة ميانمار ملتمساً منها أن تزوده بمعلومات مفصلة عن الحالة الراهنة للسيد كياو هلا أونغ وأن توضح الأحكام القانونية التي تبرر القبض عليه واستمرار احتجازه.

13. Khun Htun Oo, Sai Nyunt Lwin, Nyi Nyi Moe, Sai Hla Aung, Htun Nyo, Sai Myo Win Htun and Hso Ten were further sentenced to five years' imprisonment and hard labour pursuant to Section 6 of the 1988 Law Relating to Forming of Organizations (criminal case No. 236/05).
13- وحكم على خون هتون أو وساي نيونت لوين وني ني مو وساي هلا أونغ وتون نيو وساي نيو وين هتون وهسو تن بالسجن أيضاً لمدة خمس سنوات مع الأشغال الشاقة عملاً بالمادة 6 من القانون المتصل بتشكيل المنظمات لعام 1988 (القضية الجنائية رقم 236/05).
