8. Article 27 provides: " The juvenile courts have sole competence for hearing such juvenile offence and cases involving the risk of delinquency as are referred to them by the social welfare authorities.
`8` المادة 27 تنص على أن (تختص محكمة الأحداث دون غيرها بالنظر في أمر الحدث عند التزامه في جناية أو جنحة أو عند تعرضه للانحراف إذا رأت هيئة رعاية الأحداث ذلك.

The Committee recommends that the State party seek to strengthen the Child Welfare Authority by increasing its budgetary allocations, as well as its power and authority to implement the Convention.

213. The above-mentioned Act further indicates that, if a juvenile is found to be in a situation in which he is at risk of becoming delinquent, the Juvenile Welfare Authority may bring him before the Department of Juvenile Prosecutions in preparation for a court hearing if such is required in the interests of the juvenile.
٣١٢- كما أن القانون آنف الذكر أشار إلى أنه إذا وجد الحدث في أحد الحالات التي يعتبر فيها معرضاً للانحراف عرضت هيئة رعاية اﻷحداث على نيابة اﻷحداث لتقديمه للمحكمة إذا اقتضت مصلحته ذلك.

Article 46 (2) prescribes that persons under 18 shall not be taken into custody without hearing a social Welfare Authority or the Ombudsman for Aliens.

26. Children: The Child Welfare Authority is the principal institution tasked with promoting children's welfare. 26- الطفل: هيئة رعاية الطفولة البنية المؤسساتية التي تهتم برعاية الطفل، وتعمل على وضع إطار عام لسياسة وطنية؛ لتغير واقع الطفل طبقا للدستور العراقي، واتفاقية حقوق الطفل، والبروتوكولين الملحقين بها.

41. The Child Welfare Authority was established, bringing together a number of relevant ministries including the Ministry of Human Rights. The Minister for Labour and Social Affairs presides over the Authority, which works to improve the situation of Iraqi children.

76- وبخصوص الآثار المترتبة على الظاهرة، أظهرت دراسة بحثية قدمت في مؤتمر الطفل الثاني الذي عقدته هيئة رعاية الطفولة عام 2011 أن من أهم الآثار المترتبة على الأطفال من هذه الظاهرة هي:

Article 26 states that the juvenile court shall have judicial penal jurisdiction in all cases involving delinquent juveniles and judicial power to examine the conditions of juveniles prone to delinquency in the cases presented to the court by the Juvenile Welfare Commission through the Juvenile Parquet.
وجاء في المادة 26 أن لمحكمة الأحداث سلطة قضائية جزائية في جميع قضايا الأحداث المنحرفين وسلطة قضائية للنظر في ظروف الأحداث المعرضين للانحراف الذين ترى هيئة رعاية الأحداث عرضهم على المحكمة عن طريق نيابة الأحداث.

Under article 26 of the Law, these juvenile courts have sole jurisdiction to hear cases involving young offenders, and sole authority to look into the circumstances of minors who are at risk of delinquency and whose cases the Youth Welfare Commission has seen fit to submit to the court, acting through the special prosecution service for juvenile cases.

30. At national level, Parliament has passed the Disabled Welfare Commission Act. There is another bill, put forward by the Ministry of Labour and Social Affairs entitled, " Persons with special needs welfare bill " .
30- وعلى الصعيد الوطني فقد شرع البرلمان (قانون هيئة رعاية المعاقين)، إضافة إلى مشروع قانون أخر معروض من قبل وزارة العمل والشؤون الاجتماعية باسم (مشروع قانون دائرة رعاية ذوي الاحتياجات الخاصة).

7. Article 26 provides: " The juvenile courts shall have criminal jurisdiction over all cases of juvenile delinquency and shall have the delegated power to review the circumstances of any minors at risk of delinquency whom the social welfare authorities decide to refer to them through the juvenile prosecution service. "
