24. Her delegation also considered the version of draft article 16 proposed by the Special Rapporteur, which provided for the adoption of appropriate measures through the establishment of institutional arrangements, more acceptable than the version prepared by the Drafting Committee, which widened the scope of implementation of such measures by requiring States to adopt legislation and regulations to prevent, mitigate and prepare for disasters.

If IMO determines that the conditions in that area correspond to the requirements set out in article 211, paragraph 6, the coastal States may adopt laws and regulations for the prevention, reduction and control of pollution from vessels implementing such international rules and standards or navigational practices as are made applicable, through IMO, for special areas.2
وإذا قررت المنظمة البحرية الدولية أن الأحوال في تلك المنطقة مطابقة للمتطلبات المحددة في الفقرة 6 من المادة 211 جاز للدول الساحلية اعتماد قوانين وأنظمة لمنع التلوث الصادر عن السفن وخفضه والسيطرة عليه بتنفيذ ما ينطبق من قواعد ومعايير دولية أو ممارسات ملاحية، عن طريق المنظمة البحرية الدولية، لأجل المناطق الخاصة(2).
