7.8 The Committee recalls that, for article 3 of the Convention to apply, the individual concerned must face a foreseeable and real risk of being subjected to torture in the country to which he/she is being returned, and that this danger must be personal and present.

For the above-mentioned reasons, the Committee finds that the complainant has not provided substantial grounds for believing that he would be in danger of being tortured were he to be returned to Tunisia and that such danger is personal and present.
وترى اللجنة للأسباب السالفة الذكر، أن مقدم الشكوى لم يقدم أسباباً قوية تدعو إلى الاعتقاد بأنه سيكون في خطر التعذيب إذا أعيد إلى تونس وأن هذا الخطر شخصي وقائم.

7. The author must establish that he/she would be in danger of being tortured and that the grounds for so believing are substantial in the way described, and that such danger is personal and present.

The Committee recalls that in accordance with its general comment No. 1,h it is for the complainant to present an arguable case and to establish that he would be in danger of being tortured and that the grounds for so believing are substantial in the way described, and that such danger is personal and present.
