The Committee regrets the absence of comprehensive and disaggregated data on complaints, investigations, prosecutions and convictions of cases of torture and ill-treatment by law enforcement, security, intelligence and prison personnel, as well as on trafficking, ill-treatment of migrant workers, and domestic and sexual violence.
28- تأسف اللجنة لعدم تقديم بيانات شاملة ومصنفة بشأن الشكاوى والتحقيقات والملاحقات القضائية والإدانات المتصلة بحالات التعذيب وسوء المعاملة على يد الموظفين المكلفين بإنفاذ القوانين وأفراد الأمن والاستخبارات وموظفي السجون، وبشأن الاتجار وسوء معاملة العمال المهاجرين والعنف المنزلي والجنسي.

(28) The Committee regrets the absence of comprehensive and disaggregated data on complaints, investigations, prosecutions and convictions of cases of torture and ill-treatment by law enforcement, security, intelligence and prison personnel, as well as on trafficking, ill-treatment of migrant workers, and domestic and sexual violence.

The State party should collect and submit statistical data, disaggregated by age and sex of the victim, that would be useful in monitoring implementation of the Convention at the national level, particularly data on complaints, investigations, prosecutions and convictions related to acts of torture and ill-treatment attributed to law enforcement personnel.
ينبغي للدولة الطرف أن تجمع وتقدم بيانات إحصائية مُصنَّفة بحسب عمر الضحايا ونوع جنسهم ومفيدة لرصد تطبيق الاتفاقية على المستوى الوطني، ولا سيما البيانات المتعلقة بالشكاوى والتحقيقات والملاحقات القضائية والإدانات المتصلة بأفعال التعذيب وسوء المعاملة التي تُعزى إلى موظفي إنفاذ القانون.

The State party should gather statistics that are useful for monitoring the implementation of the Convention at the national level, including data on complaints, investigations, prosecutions and convictions in cases of torture, ill-treatment and other types of human rights violations as mentioned above, and on the types of redress, compensation and rehabilitation offered to victims.
ينبغي للدولة الطرف جمع بيانات إحصائية ذات صلة لأغراض رصد تطبيق الاتفاقية على المستوى الوطني، ولا سيما البيانات المتعلقة بالشكاوى المقدمة والتحريات والملاحقات القضائية والإدانات المتصلة بالتعذيب وسوء المعاملة وغيرها من أشكال انتهاكات حقوق الإنسان المشار إليها، وكذلك عن سبل الانتصاف، والتعويض وإعادة التأهيل المقدمة إلى الضحايا.

(b) The absence or small number of complaints, prosecutions and convictions relating to acts of racial discrimination in the country.
(ب) عدم وجود أو قلة عدد الشكاوى والمحاكمات والإدانات المتصلة بأفعال التمييز العنصري في البلد.

The Committee, recalling its general recommendation 31 on the prevention of racial discrimination in the administration and functioning of the criminal justice system, reminds the State party that the small number of complaints, prosecutions and convictions relating to acts of racial discrimination should not be viewed as being necessarily positive.
إذ تشير اللجنة إلى توصيتها العامة 31 بشأن منع التمييز العنصري في إدارة وسير عمل نظام العدالة الجنائية، تذكّر الدولةَ الطرف بأن قلة عدد الشكاوى والمحاكمات والإدانات المتصلة بأفعال التمييز العنصري لا ينبغي اعتباره إيجابياً بالضرورة.

3. In particular, States parties should have access to comprehensive statistical or other information on complaints, prosecutions and convictions relating to acts of racism and xenophobia, as well as on compensation awarded to the victims of such acts, whether such compensation is paid by the perpetrators of the offences or under State compensation plans financed from public funds.
3- وينبغي بصفة خاصة أن يكون في مقدور الدول الأطراف الوصول إلى معلومات إحصائية شاملة أو إلى غير ذلك من المعلومات عن الشكاوى والمحاكمات والإدانات المتصلة بأفعال العنصرية وكره الأجانب، وكذلك عن التعويضات المدفوعة لضحايا هذه الأفعال سواء تم دفع هذه التعويضات من قبل مرتكبي تلك الأفعال أو في إطار خطط التعويض الحكومية التي تموَّل من الأموال العامة.

(22) While noting that some statistics have been provided, the Committee regrets the lack of comprehensive and disaggregated data on complaints, investigations, prosecutions and convictions of cases of torture and illtreatment by law enforcement officials, as well as on trafficking and domestic and sexual violence. The Committee also regrets the lack of statistics in respect of asylum seekers and noncitizens as well as interprisoner violence.
(22) بينما تحيط اللجنة علماً بتقديم بعض الإحصاءات، إلا أنها تأسف لعدم تقديم بيانات شاملة ومصنفة بشأن الشكاوى وعمليات التحقيق وعمليات الملاحقة القضائية والإدانات المتصلة بحالات التعذيب وسوء المعاملة من جانب الموظفين المكلفين بإنفاذ القانون، وكذلك بشأن الاتجار والعنف المنزلي والجنسي.كما تأسف اللجنة لعدم تقديم إحصاءات تتعلق بملتمسي اللجوء وغير المواطنين، وكذلك بالعنف بين السجناء.
