It noted that, while the national report stated that freedom of association and assembly was a constitutional principle, the OHCHR compilation expressed concerns regarding the closing of newspapers in 2008 and allegations of torture in the context of a general strike in 2007.

34. The Committee recommends that the State party establish clear criteria to assess whether a given action or expression is in accordance with interpretations of Islamic texts, and consider appropriate and proportionate means to protect public morals while safeguarding the right of every child to freedom of expression and assembly.
34- وتوصي اللجنة الدولة الطرف بوضع معايير واضحة لتقييم ما إذا كان فعل أو تعبير ما يتمشى أم لا مع تأويلات نصوص الشريعة الإسلامية، والنظر في إمكانية اتخاذ تدابير مناسبة ومتناسبة لحماية الأخلاق العامة وفي نفس الوقت ضمان حق كل طفل في التمتع بحرية التعبير والتجمّع.

In December 2011, the High Commissioner called on the Government to urgently take confidence-building measures, including unconditionally releasing those who had been convicted in military tribunals or were still awaiting trial for merely exercising their fundamental rights to freedom of expression and assembly.

It is also concerned that security forces, whose leadership generally excludes Jordanians of Palestinian descent, continue to exercise significant influence over Jordanian political life in a manner that limits citizens' freedoms of speech and assembly (art. 5 (c)).
ويساورها القلق أيضاً لأن المناصب القيادية في قوات الأمن تستبعد بصفة عامة الأردنيين من أصل فلسطيني، وأن قوات الأمن مستمرة في ممارسة نفوذ كبير على الحياة السياسية الأردنية بطريقة تحد من حرية المواطنين في الكلام والتجمّع (المادة 5(ج)).

33. The Committee is concerned that although the freedoms of expression and assembly are formally recognized in the Constitution, the exercise of these rights by children are restricted by vaguely worded limitation clauses (i.e. " in accordance with Islamic criteria " ), which potentially exceed the permitted restrictions set out in paragraph 2 of articles 13 and 15 of the Convention.
33- يساور اللجنة القلق لأنه على الرغم من أن حريتي التعبير والتجمّع معترف بهما رسميا في الدستور، فإن ممارسة الأطفال لهذين الحقين ممارسة مقيدة بأحكام غامضة الصياغة (منها عبارة " وفقا للمعايير الإسلامية " )، وهو ما قد يتجاوز القيود المباحة المذكورة في الفقرة 2 من المادة 13 وفي المادة 15 من الاتفاقية.

The fundamental freedoms of expression and association were essential, including for the promotion and protection of economic, social and cultural rights and the right to development.
فالحريات الأساسية للتعبير والتجمّع هي حريات جوهرية، كما أنها مهمة لتعزيز وحماية الحقوق الاقتصادية والاجتماعية والثقافية والحق في التنمية.
