First, the Panel is called upon to interpret the clause “without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990” (hereinafter referred to as the “arising prior to” clause).

Accordingly, the Panel finds that the terms “debts and obligations of Iraq arising prior to 2 August 1990 " means a debt or an obligation that is based on work performed or services rendered prior to 2 May 1990.Further, the Panel notes that the debts and obligations that are affected by the “arising prior to” clause are debts and obligations of Iraq.

(a) The phrase " without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through normal mechanisms " was intended to have an exclusionary effect on the Commission's jurisdiction, i.e. such debts and obligations are not compensable by the Commission;
(أ) القصد من عبارة " دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " هو أن يكون لها أثر استبعادي يقيد نطاق اختصاص اللجنة بمعنى أن تكون هذه الديون والالتزامات غير قابلة للتعويض من جانبها؛

Iraq, without prejudice to the debts and obligations of Iraq arising prior to 2 August 1990, which will be addressed through the normal mechanisms, is liable under international law for any direct loss, damage ... or injury to foreign Governments, nationals and corporations, as a result of Iraq’s unlawful invasion and occupation of Kuwait”.

(أ) كان الغرض من جملة " دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " ، هو أن يكون لها أثر استبعادي على اختصاص اللجنة، أي أن مثل هذه الديون والالتزامات غير قابلة للتعويض من قِبَل اللجنة؛

Debts and obligations of Iraq arising prior to 2 August 1990 are outside the jurisdiction of the Commission, pursuant to Security Council resolution 687 (1990).The Panel confirms the application to the present instalment of its findings in paragraph 90 of its first report with respect to the Commission’s jurisdiction over such debts, namely:
151- وقد نظر الفريق في السابق في قابلية المطالبات التي تستند إلى العقود مع العراق للتعويض، والتي يُدعى أنه تم خرقها أو جعل أدائها مستحيلاً. وديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1991 تقع خارج نطاق ولاية اللجنة، عملاً بقرار مجلس الأمن 687(1990)(71).

In deciding whether it has jurisdiction over these claims, the Panel must apply the findings in its first report in respect of the clause in paragraph 16 of Security Council resolution 687 (1991), which excludes from the jurisdiction of the Commission " the debts and obligations of Iraq arising prior to 2 August 1990 " (the " arising prior to " clause).
16- ولدى البت فيما إذا كانت للجنة ولاية على هذه المطالبات، ينبغي للفريق أن يطبق النتائج التي توصل إليها في تقريره الأول فيما يتعلق بالشرط الوارد في الفقرة 16 من قرار مجلس الأمن 687(1991)، الذي يستبعد من ولاية اللجنة ديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 (شرط " الناشئة قبل " ).

62- طبق الفريق، عند البت فيما إذا كانت المطالبات تدخل في نطاق اختصاصه، الفقرة 16 من قرار مجلس الأمن 687(1991) الذي يستبعد من نطاق اختصاص اللجنة " ديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 " (شرط " الناشئة قبل " ).
