The Court must thus have automatic jurisdiction over war crimes and crimes against humanity, not just over genocide.
ويجب أن يكون للمحكمة بالتالي الاختصاص التلقائي على جرائم الحرب والجرائم ضد الانسانية ، وليس فقط على جرائم الابادة الجماعية .

While the new statute did not confer on the court generic jurisdiction over violations of customary international law, it granted the court jurisdiction over four types of specific crimes: genocide, aggression, serious violations of the laws applicable in armed conflicts and crimes against humanity.

56. As to the crimes to be covered by the statute and their specification, the court should have jurisdiction only over the most serious crimes of concern to the international community as a whole, namely genocide, aggression, serious violations of the laws and customs applicable in armed conflict, and crimes against humanity.
٥٦ - وفيما يخص الجرائم التي ينبغي أن تخضع للنظام اﻷساسي وتحديد تلك الجرائم، فإنه ينبغي أن يكون اختصاص المحكمة مقصورا على أخطر الجرائم التي تهم المجتمع الدولي بأسره، وهي جرائم اﻹبادة الجماعية والعدوان والانتهاكات الخطيرة للقوانين واﻷعراف المنطبقة في المنازعات المسلحة والجرائم ضد الانسانية.

Mr. NGATSE (Congo) said that the Court should have jurisdiction over genocide, as defined in the 1948 Geneva Convention, war crimes and crimes against humanity, and also over aggression.
٥٥ - السيد نغاتسه )الكونغو( : قال ينبغي أن يكون للمحكمة اختصاص على الابادة الجماعية ، على النحو المعرﱠف في اتفاقية جنيف لسنة ٨٤٩١ ، وعلى جرائم الحرب والجرائم ضد الانسانية وكذلك على العدوان .

Mr. Sayyid Said Hilal AL-BUSAIDY (Oman) said that he was in favour of an effective, balanced and independent court with jurisdiction over genocide and crimes against humanity committed during armed conflicts.
٠٩ - السيد سيد سعيد هلال البوسعيدي )عُمان( : قال انه يحبذ وجود محكمة فعالة متوازنة ومستقلة ولها اختصاص على الابادة الجماعية والجرائم ضد الانسانية التي ترتكب أثناء المنازعات المسلحة .

٧ - السيد ولدولدي )اثيوبيا( : قال ان الجرائم مثل الابادة الجماعية وجرائم الحرب والجرائم ضد الانسانية تتطلب عقوبات متناسبة مع مدى خطورتها وان استبعاد عقوبة الاعدام من مثل هذه الجرائم يعتبر غير مقبول .

The view had also been expressed that the automatic acceptance of the Court’s jurisdiction should only apply with respect to genocide and crimes against humanity, and that war crimes should not fall under that system but be governed by another jurisdictional regime.
٢٣ - وقد أبدي رأي مفاده أن القبول التلقائي لاختصاص المحكمة ينبغي أن ينطبق فقط فيما يتعلق بجريمة الابادة الجماعية والجرائم ضد الانسانية ، وأن جرائم الحرب لا ينبغي أن تدخل تحت هذا النظام ، بيد أنها يجب أن يحكمها نظام اختصاص آخر .

1. Article 20 of the draft statute provides that the International Criminal Court has jurisdiction over the crimes of " genocide " , " aggression " , " serious violations of the laws and customs applicable in armed conflict " , and " crimes against humanity " , but it contains no provisions for the requisites constituting these crimes.
١ - تنص المادة ٢٠ من مشروع النظام اﻷساسي على أن المحكمة الجنائية الدولية تختص بالنظر في جرائم " الابادة الجماعية " ، و " العدوان " ، و " الانتهاكات الجسيمة للقوانين واﻷعراف التي تسري على المنازعات المسلحة " ، " والجرائم ضد الانسانية " ؛ إلا أنها لا تتضمن أحكاما للمقومات اﻷساسية التي تشكل هـذه الجرائــم.

٣٤١- السيد ايفان )رومانيا( : قال ان وفده يحبذ ، من حيث المبدأ ، الاختصاص العالمي بيد أنه يمكنه أن يقبل الاختصاص التلقائي فيما يتعلق بالابادة الجماعية وجرائم الحرب والجرائم ضد الانسانية وفيما يتعلق بالعدوان اذا ما أُدرج .

Ms. TOMIČ (Slovenia) said that the Court should have automatic jurisdiction in respect of the core crimes of genocide, war crimes and crimes against humanity, upon ratification of the Statute by the State concerned.
٢٤ - السيدة توميتش )سلوفينيا( : قالت ان المحكمة ينبغي أن يكون لها اختصاص تلقائي فيما يتعلق بالجرائم اﻷساسية للابادة الجماعية وجرائم الحرب والجرائم ضد الانسانية ، بعد التصديق على النظام اﻷساسي من الدول المعنية .
