However, under article 5, paragraph 1, nothing in the Covenant may be interpreted as implying for a State a right to perform any act aimed at the limitation of any of the rights and freedoms recognized therein to a greater extent than is provided for in the Covenant.
غير أن الفقرة ١ من المادة ٥ لا تنطوي على ما يمكن تفسيره في العهد على أنه يعني حقا للدولة في أن تقوم بأي عمل يستهدف تقييد أي من الحقوق والحريات المعترف بها في العهد تقييدا أشمل مما هو منصوص عليه في العهد.

The first provision prohibits any State, group or person to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized in the Covenant.
فالحكم اﻷول يحظر على أي دولة أو مجموعة أو شخص القيام بأي نشاط أو أي فعل يرمي إلى إهدار أي من الحقوق والحريات المعترف بها في العهد.

44. With regard to the remedies available in the case of any violation of rights and freedoms recognized in the Covenant, the following should be mentioned.
٤٤ - وفي حالة سبل الانتصاف المتاحة في حالة حدوث أي انتهاك للحقوق والحريات المعترف بها في العهد ينبغي الاشارة إلى ما يلي.

The obligations contained in the Covenant have been accepted on behalf of Tokelau and there is no intention of deviating from those obligations; nor has Tokelau restricted or derogated from any of the rights and freedoms recognized in the Covenant.
730- قُبلت الالتزامات الواردة في العهد باسم توكيلاو، وليس هناك أي نية للانحراف عن هذه الالتزامات، كما أن توكيلاو لا تنوي تقييد أو فسخ الحقوق والحريات المعترف بها في العهد.

ولما كانت أحكام الدستور تكفل فيما يبدو الحقوق والحريات للمواطنين فقط، فان اللجنة توجه انتباه الدولة الطرف إلى التزاماتها بتأمين الحقوق والحريات المعترف بها في العهد لكل اﻷفراد الذين يخضعون لولايتها القضائية.

4.9 Regarding the alleged violation of article 5, paragraphs 1 and 2, the State party maintains that it has not been expressly substantiated, as the author has not specified in what way a State, a group or person was granted the right to engage in activities or perform acts aimed at the destruction of any of the rights and freedoms recognized in the Covenant.
4-9 وفيما يتعلق بالانتهاك المزعوم للفقرتين 1 و2 من المادة 5، تؤكد الدولة الطرف أن صاحب البلاغ لم يقدم أدلة واضحة كافية لإثبات هذا الادعاء، ذلك أنه لم يثبت أن دولة أو جماعة أو فرداً قد مُنحوا حقّ الاضطلاع بأنشطة أو القيام بأفعال تهدف إلى دوس أي من الحقوق والحريات المعترف بها في العهد.

20. Article 15, paragraph 1 (a) may not be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized in the Covenant or at their limitation to a greater extent than is provided for therein.
20- ولا يجوز تـأويل الفقرة 1(أ) من المادة 15 على أنها تنطوي على أي حق لأي دولة أو جماعة أو شخص في مباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق والحريات المعترف بها في العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه().

20- ولا يجوز تـأوبل الفقرة 1(أ) من المادة 15 على أنها تنطوي على أي حق لأي دولة أو جماعة أو شخص في مباشرة أي نشاط أو القيام بأي عمل يهدف إلى إهدار أي من الحقوق والحريات المعترف بها في العهد أو إلى فرض قيود عليها أوسع من تلك المنصوص عليها فيه().

Thus the constitutional system in Sudan recognizes that there is no provision in that Covenant that may be interpreted as implying any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms recognized therein or at their limitation to a greater extent than is provided in it.
ولذلك فإن النظام الدستوري في السودان يعترف بعدم وجود حكم في الدستور يجوز تأويله على نحوٍ يفيد انطواءه على حق يمكِّن من مباشرة أي نشاط، أو القيام بأي عمل يهدف إلى إهدار أيٍ من الحقوق والحريات المعترف بها في العهد أو إلى فرض قيود عليها أوسع من التي نُصَّ عليها فيه.
